�CEPOL’s legal framework�

Established as European Police College by Council Decision 2000/820/JHA, CEPOL became operational on 1 January 2001 and became an Agency in 2005. As of 1st of July 2016 (entry into application of the CEPOL Regulation) CEPOL became the European Union Agency for Law Enforcement Training (the acronym remains unchanged).

CEPOL's mission is to provide training and learning opportunities to law enforcement officers on issues vital to the security of the European Union and its citizens. Training covers topics ranging from leadership to law enforcement techniques and from EU cooperation to economic crime. Activities are designed to facilitate the sharing of knowledge and best practices and to contribute to the development of a common European law enforcement culture.

CEPOL is governed by Regulation (EU) 2015/2219 which entered into force on 1^st July 2016. It replaces its third pillar legal basis and extends the agency's mandate (from senior police officers to all ranks law enforcement officers).

Art. 4 - CEPOL’s tasks

Prepare multi-annual strategic training needs analyses and multi-annual learning programmes;
support, develop, implement and coordinate training activities and learning products;
support Union missions and capacity-building in third countries;
promote the mutual recognition of law enforcement training in Member States and the recognition by Member States of training provided at Union level with due regard to the principle of subsidiarity.

Art. 6 - CEPOL National Units

Each Member State designates a CEPOL National Unit (CNU)
CNU = Liaison body between CEPOL and national training institutes for law enforcement officials in MS
Set up and functioning in accordance with national law
The CNUs meet twice a year at CEPOL

1.Each Member State shall establish or designate a national unit, which shall be the liaison body with CEPOL within its network of national training institutes for law enforcement officials in the Member States. 2.The national units shall be responsible for carrying out the tasks set out in this Article. (see next slide) 3.The representatives of the national units shall meet on a regular basis, at the request of the Management Board, of the Executive Director or on their own initiative, in relation to CEPOL's operational and educational matters. They shall, in particular, consider and develop proposals that improve CEPOL's operational effectiveness and encourage commitment by the Member States. 4.Each Member State shall determine the organisation and the staff of its national unit in accordance with its national law and resources.

Art. 6 – CEPOL National Unit tasks

- Supply CEPOL with the information necessary to fulfil its objectives
- Contribute to CEPOL's communication and cooperation with all relevant training institutes
- Contribute to and promote CEPOL's activities
- Organise and coordinate the nomination of training courses participants and experts
- Coordinate the implementation of activities within their MS
- Support the establishment and implementation of exchange programmes

2.The national units shall be responsible for carrying out the tasks set out in this Article. They shall, in particular: (a) supply CEPOL with the information necessary for it to carry out its tasks; (b) contribute to CEPOL's effective communication and cooperation with all relevant training institutes, including relevant research institutes in the Member States; (c) contribute to and promote CEPOL's work programmes, annual calendars and website; (d) respond to CEPOL's requests for information and advice; (e) organise and coordinate appropriate nominations of participants and experts for activities at the national level in a timely and transparent manner; (f) coordinate the implementation of activities and meetings within their Member State; (g) provide support in the establishment and implementation of exchange programmes for law enforcement officials; (h) promote the use of CEPOL's electronic network for the training of law enforcement officials.

Art. 8-9 - Management Board

- One representative and alternate member per Member State. Reference to gender balance.

The Management Board

- Is responsible for the overall administration of the agency, including programming documents
- Takes decisions on the strategic objectives of the agency
- Adopts all learning tools

Art. 17 – CEPOL Budget

- Management Board adopts a provisional draft estimate for the following year
- Commission proposes draft Europol budget as part of the EU Draft Budget
- European Parliament and Council agree on final level of appropriations and staff (“conciliation”)
- Management Board adopts Europol budget
