Basics:

You do not have to be, nor are you, an expert in Immigration Rights or Law Enforcement Encounters - You are authentically you, and people need to learn this information - from you.

None of us can afford to have imposter syndrome or be paralyzed by fear at this point. We need to share the information in this training as broadly as possible to let the largest number of people know what their rights and resources are, and how to answer questions in the future.

This training provides participants with basic, foundational knowledge about immigration enforcement practices, legal rights during ICE encounters, and strategies individuals and organizations can use to prepare and respond safely in person, at home, on the streets or at work.

The session emphasizes empowerment through knowledge, preparedness planning, and community support networks.

Remember:

You will have MANY different audiences.
Arrive early. Bring your presentation on a flash drive. Bring handouts.
Speak in a LOUD, clear, slow, engaging fashion.
Remember that this is a bilingual presentation - let Spanish speakers know that content will be repeated in Spanish, usually on the next slide.
You can also delete Spanish slides if you are sure you will not have any Spanish speakers in the audience.
Don’t have distracting body language.
Assume anything that can go wrong will - bring the training on a flash drive, prepare for faulty mics, blackouts, hecklers and leaks.
Use pauses when speaking
Vary your volume and intonation. Move around a little. Smile/eye contact.
Pause for some audience, feedback and questions.
Do not use sarcasm. Try not to curse (well….not TOO much)
Use humor where possible.
Don’t allow people to derail your training - let them know you’ll answer questions after the training if necessary, or share your card
Don’t make up answers. Get back to the training convener with any answers you must look up.
Center the importance for people to be “calm” community leaders in their neighborhoods.
Get people to volunteer - as Legal Observers, Migra Watch, Tutors, attending City or County gov’t meetings.
Direct people where they can get help or answers

As of February 2026, 74% of 68,000 detainees (immigrants in detention) have committed no crime other than overstaying a visa - which is a felony misdemeanor, like eating an edible from a Chicago dispensary, or using an unauthorized reproduction of Smokey the Bear - both felony misdemeanors. https://tracreports.org

If you are detained, you have the right to call & receive visits from lawyers, consulates, families

ICE needs a judicial warrant in any non-public spaces (home, business) - NOT an administrative warrant which say “Department of Homeland Security” and are on Forms I-200 or I-205.

JUDICIAL WARRANTS allow law enforcement officers entry into private spaces such as homes, cars, offices etc.

ADMINISTRATIVE WARRANTS only allow ICE to detain someone suspected of immigration violations if they find them in public OR are granted access to a private space where the person can be found.

ICE ALMOST NEVER HAS JUDICIAL WARRANTS, ONLY ADMINISTRATIVE because the bar for a court to issue a judicial warrant is very high

Key differences:

Judicial warrants are isssued by a US District Court (a third party outside DHS that can evaluate evidence objectively and weigh it against the gravity of taking away someone’s constitutional rights) VS. administrative warrants are issued by the US Department of Homeland Security which is ICE’s parent agency and not neutral.
Judicial warrants are signed by a judge or magistrate (again, an objective third party) and valid only for 14 days after issuance, and for specific locations and items, VS administrative warrants are signed by a senior immigration officer (often the direct supervisor of the officers executing the warrant - basically an internal memo from a boss to their subordinates.

Legal Observer (LO)

Legal observers are trained members of a program who attend public demonstrations, protests and other events where there may be a potential for conflict or interactions between the public and the police or other law enforcement officers (LEO).

Their purpose is to monitor, record and report any unlawful or improper behavior by LEOs. The presence of LOs can be a deterrent to this behavior.

Verifiers

Trained participants of a program coordinated by Comite Sin Fronteras who travel to reported locations to confirm or deny activity of ICE, CBP or Immigration Enforcement Actions.

They help to verify and publicly report on incidents, and dispel rumors and misinformation.
