As of February 2026, 74% of 68,000 detainees (immigrants in detention) have committed no crime other than overstaying a visa - which is a felony misdemeanor, like eating an edible from a Chicago dispensary, or using an unauthorized reproduction of Smokey the Bear - both felony misdemeanors. https://tracreports.org

Know Your Rights

  • If you are detained, you have the right to call & receive visits from lawyers, consulates, families
  • ICE needs a judicial warrant in any non-public spaces (home, business) - NOT an administrative warrant which say “Department of Homeland Security” and are on Forms I-200 or I-205.
  • Record and share all ICE interactions
  • Contact an attorney & immigrant rights group
  • Don’t say or sign anything until an attorney tells you it’s OK to do so

  2. Have a plan for guardianship of children
  3. Who can access your finances?
  4. Make sure to have medications on hand
  5. Have numbers for immigration attorneys

  7. Have copies of all important documents in a binder
  8. Share copies of binders with other adults and/or lawyers

Legal Observer (LO)

Legal observers are trained members of a program who attend public demonstrations, protests and other events where there may be a potential for conflict or interactions between the public and the police or other law enforcement officers (LEO).

Their purpose is to monitor, record and report any unlawful or improper behavior by LEOs. The presence of LOs can be a deterrent to this behavior.

Verifiers

Trained participants of a program coordinated by Comite Sin Fronteras who travel to reported locations to confirm or deny activity of ICE, CBP or Immigration Enforcement Actions.

They help to verify and publicly report on incidents, and dispel rumors and misinformation.
