FOURTH AMENDMENT

The Fourth Amendment protects people from unreasonable searches and seizures by the government.

Unreasonable searches and seizures of:

Their persons
Houses
Personal legal documents and effects.

Searches & Warrants

The Fourth Amendment protects people from unreasonable searches and seizures by the government. The Fourth Amendment protects people from unreasonable searches and seizures of their persons, houses, papers, and effects. ��Privacy�The Fourth Amendment protects a person's reasonable expectation of privacy.

What does the Fourth Amendment require?

Warrants� The government must obtain a warrant before searching or seizing a person's property.
Probable cause� The warrant must be supported by probable cause, which is an oath or affirmation.
Description� The warrant must specifically describe the place to be searched and the people or things to be seized.

When is a search considered reasonable?

A search is considered reasonable if it balances the individual's Fourth Amendment rights with legitimate government interests, such as public safety.
Some searches are presumptively unreasonable, such as searches of a home without a warrant.

What are some exceptions to the Fourth Amendment?

A search may be lawful if the officer has consent to search.
A search may be lawful if it's incident to a lawful arrest.
A search may be lawful if there's probable cause and exigent circumstances.

Do not lie to an immigration officer could be considered a crime. Even though it feels risky, the most information you should provide (if detained), is your correct name and date of birth. Do not carry a passport. A passport is a travel document and if you have it on you while detained, it can help ICE deport you faster.

Do not provide a foreign ID, this includes your consulate card, foreign driver’s license, foreign voting card, etc. A foreign ID reveals to the ICE agent that you were born in another country that is not the U.S.

Do not open the door (not even with the security chain)
Ask the agent/officer to slide their order under your door and verify that it is signed by an immigration judge
If immigration agents enter your home without your permission, tell them you do not give them permission to enter your home or search your belongings
Do not sign any documents before speaking to an attorney

Here is what someone could do if an immigration agent (ICE, CBP, HSI) shows up at home

Do not open the door (not even with the security chain)

Once you open the door, you risk losing certain rights as well as putting other people in the household at risk of detainment as collateral.

If your screen door is open and they see you, it’s hard to avoid speaking to the officer, you can ask the agent/officer to slide their order under your door and verify that it is a valid judicial warrant that is signed by a judge

If the order is signed by a judge and it has your name and address, you need to allow them to enter your home.

If immigration agents enter your home without your permission, verbally express that you do not give them permission to enter your home or search your belongings. Ask for a search and arrest warrant.
You have the right to speak to an attorney.
If you feel safe, record the event with your cell phone either through video or audio only
In San Bernardino and Los Angeles, ICE is not supposed to “knock-talk-and-arrest” and there's a similar lawsuit that that was in Chicago as well. This means that ICE cannot go around knocking on doors to intimate people into talking too much, sometimes by lying and saying they are the police

Remain calm and do not run

Even if an immigration agent enters, for instance, a restaurant, without a warrant, agents cannot enter private areas in the establishment, including employee areas.

Attorneys are also advising that immigrants have proof of having been in 2 years handy – this goes into another training

KYR AT SCHOOL

All children have a right to a free and public education
LAUSD Schools are designated as sanctuaries and safe zones from immigration enforcement

What about union-charter schools

If immigration agents show up on a school campus, Principals or designess must follow a series of policy steps to comply with sanctuary policy

Principals must collect information (warrant type, badge numbers, etc.) and have to receive direction from operations to know how to comply with the warrant
REF 6767.3 - all UTLA members should read it - and make sure their principals are ready to implement it if an immigration agent were to show up at their school

There is no law that obligates any school staff to support any immigration enforcement, including retrieving a student for immigration students
UTLA educators can enforce school sanctuary policy by wearing their buttons, posters, and training members on the sanctuary policy

KYR AT WORKSITES

Every worksite might have different protocols, but the goal is to minimize the contact employees have with immigration agents
The immigration agents need to have a search warrant (signed by a judge)
If the agents only present an “Administrative Warrant” (not a court ordered warrant signed by a judge), your employer is not obligated to give them permission to enter the workplace.
Keep calm. Do not run or try to escape!

(This will give the officers probable cause to arrest you)

Have copies of “red cards” for staff

Every worksite might have different protocols, but the goal is to minimize the contact employees have with immigration agents. Immigration agents need to have a search warrant (signed by a judge). Immigration agents cannot enter private spaces (and even then, the warrant will have details of where they can be).

��For staff that is worried remember to have a plan:

Fill out your preparedness plan and put it in a folder labeled “Privilege & Confidential” and give it to a person you trust. Create a plan in advance with your family and friends. Assign who will be in charge of your case and who will support at different capacities. Make sure your photos and videos are being synced to the cloud (e.g. iCloud or Google photos) in case you record an interaction with ICE so that other people can access it. Join a local pro immigrant rights group. Download the applications like *Notifica App* and add your emergency contacts with an emergency message. We suggest that this message includes the contact of a trusted person that has and knows your preparedness plan.

There are Immigrant Justice Area Team leads in each area that should contact me, Maria Miranda if an immigration agent were to show up at your school or if immigration enforcement is happening right outside a school. If a community member also alerts you of an Immigration Enforcement Agent presence in the community then please ask the time they saw them, a picture of the agents whenever possible. We will then activate the Rapid Response Team that we are collaborating in with CHIRLA and other organizations and unions.

We will notify our communications department after Immigration Enforcement is confirmed at a school site or in the community.

UTLA is lead in the City Wide Rapid Response in two areas only even though we have members part of the team citywide.

We encourage you to organize with members in the community who you already have a relationship with. For example think of those who supported us during the strike. If a church offered you their building for parent meetings then it would be great if you reached out to them and offered to do a know your rights training for their congregation. If a restaurant was supportive then offer them know your rights Red Cards and invite their employees to a KYR training.

Rapid Response First Responders: in your area

Rapid Response First Responders are a group of teachers, community organization members and parents in the community. Every area has a lead who communicates with RR first responders to verify reports of Immigrant Enforcement agents in the area. Their duties are to verify a report, document what is occurring at the site, and to provide KYR information to those who may be impacted by the operation being held by immigration enforcement.
