Utah Tobacco Law
The Health Department, in partnership with Local Law Enforcement, conducts compliance at every retail location each year
Buyers under the age of 21 attempt to buy a tobacco or nicotine product at each retail location
Utah Code 76-9-1116: It is unlawful for retailers and their employees to sell or give a tobacco product, electronic cigarette product, or a nicotine product to an individual younger than 21 years old.

The Health Department conducts annual inspections at each retail location to ensure that products being sold comply with Utah Code
Utah Code 76-9-1114: As of January 1, 2025, it is unlawful for a person to give, distribute, sell, offer for sale, or furnish to any person a flavored electronic cigarette product.
Utah Code 59-14-810: A person may not sell or offer for retail sale an electronic cigarette product in Utah that is not on the electronic cigarette registry.

Utah Tobacco Law
The Health Department Tobacco Prevention and Control Team provides education on the Utah Clean Air Act to all businesses on a first offense. On subsequent offences, Environmental Health is involved to provide a violation to the business.
Utah Code 26B-7-503 and R392-510 refer to the Utah Clean Air Act, which bans smoking and vaping at all government locations and most private businesses in Utah.
