Special law of Sexual Violence Crimes and Punishment

  • Article14(Shooting with a camera, etc.)

1. A person who uses a camera or other mechanical device with similar functions to photograph the body of a person capable of inducing sexual desire or shame against the will of the subject shall be punished by imprisonment for less than five years or by a fine not exceeding 30 million won. <Amended 2018. 12. 18.>

2. A person who distributes, sells, rents, provides, or openly displays or screens a photographed material or reproduction pursuant to Paragraph 1, or even if the filming pursuant to Paragraph 1 is not against the will of the person to be photographed at the time of filming, the photographed material or reproduction A person who disseminates, etc. against the will of the person to be filmed shall be punished by imprisonment for not more than five years or by a fine of not more than 30 million won <Amended on December 18, 2018>

3. A person who commits the crime of paragraph 2 by using the information and communications network under Article 2, paragraph 1, item 1 against the will of the person to be photographed for profit shall be punished by imprisonment for not more than seven years. <Amended 2018.12.18.>

Act on Promotion of Information and Communications Network Utilization and Information Protection

1. No one shall circulate information falling under any of the following subparagraphs through information and communications networks.

2. A person who falls under any of the following subparagraphs shall be punished by imprisonment for not more than one year or by a fine of not more than 10 million won. A person who distributes, sells, rents, or openly displays obscene codes, words, sounds, images or videos in violation of Article 44-7 Paragraph 1

Criminal Law

1. A person who threatens another person shall be punished by imprisonment for not more than three years, a fine of not more than five million won, detention, or a minor fine.

2. A person who commits the crime under paragraph (1) against himself or his spouse's lineal ascendant shall be punished by imprisonment for not more than five years or by a fine not exceeding seven million won.
