WHAT IS THE MASSACHUSETTS CONTINGENCY PLAN?

  • The MCP (310 CMR 40.00) is a body of regulations, promulgated by the MassDEP in 1983
    • Intended to streamline the assessment and cleanup of releases of oil and hazardous materials (OHM) to the environment
    • Vehicle for the MassDEP to carry out MGL Chapter 21E
  • 1993 Mass revised the MCP to privatize cleanup of sites
    • Licensed Site Professional (LSP) Program
      • An environmental scientist or engineer experienced in the cleanup of oil and hazardous material contamination
    • LSPs are authorized to work on behalf of responsible parties to oversee assessment and cleanup of sites
    • LSP of Record – Timothy Clinton, CPG, LSP
  • Most recent MCP update promulgated December 2019
  • Over 44,000 confirmed and suspected hazardous waste sites across Mass

RTN 1-21489 BACKGROUND

  • 1957-1967: US Air Force leases land, constructs Terminal VHF Omni Range (TVOR) facility
  • By 1972 the TVOR facility had been deconstructed
  • 1992: Department of Defense (DOD) Installation Restoration Program (IRP) recommends removal of 275-gal gasoline Underground Storage Tank (UST)
    • UST was used to power an adjacent emergency backup generator.
  • 1994: UST, and ~100 tons petro-impacted soils, removed from Site under by Army Corp of Engineers (USACOE)

INVESTIGATION DONE TO DATE

  • Oct 2021: OTO Limited Subsurface Assessment
    • Site-wide subsurface investigation, Soil Boring B-9 shows elevated VPH Range in soil
  • Jan 2022: MassDEP notified of 120-day reportable condition
    • Triggered by VPH Range in soil boring B-9
    • Notice of Responsibility (NOR) issued, and Site assigned RTN 1-21489
  • Nov/Dec 2022: F&O Limited Phase II Subsurface Investigation
    • Eight (8) soil borings, five (5) total monitoring wells installed
  • Jan 2023: F&O Ph I Initial Site Investigation (ISI) and Tier I Classification Submittal
    • Additional GW Sampling

NEXT STEPS

  • Ongoing assessment of groundwater conditions
    • Seasonal sampling of groundwater monitoring wells
    • Better assess seasonal variation of groundwater conditions
  • Review of new data may indicate the need for additional groundwater monitoring well points in the vicinity of the existing monitoring well network

Such properties are known as Formerly Used Defense Sites or FUDS. The U.S. Army is the executive agent for the program and the U.S. Army Corps of Engineers (USACOE) manages and directs the program’s administration.
