EUSD wants bragging rights for excellence, but claims it cannot afford to pay for it. The community needs to know that this is an issue of MISPLACED PRIORITIES, NOT a lack of funding.

SUMMER 2022 (slide 1 of 2)

A Little History:

Our joint agreement (incl salary, benefits, and contract language) for the 2021-22 school year was settled in May 2021. However, at any time unions have the right by law to request additional bargaining talks for anything that “impacts” our working conditions–thus the term “Impact Bargaining.” EUTA (Eureka Union Teachers Association) requested impact bargaining for additional one-time compensation for Covid back in Nov. 2021. There was a lot of literal impact on our workloads due to updated State legislation regarding mandatory independent study in the fall, complicated also by the statewide sub shortage. In fact, that sub shortage also greatly impacted our EUSD TK-3 teachers’ ability to consistently get their prep time. So, in response to our members’ growing concerns in the fall, we asked to have a formal conversation with EUSD last November (“Impact Bargaining”). To be clear, we did not “reopen” the prior year’s collective agreement; on the contrary, we were actually responding to additional demands to our workload that were newly added after the school year began.

Because our two parties were unable to come to an agreement on the one-time compensation EUTA was requesting, this led to an impasse in March and, ultimately, State mediation. Unable to reach an agreement after three sessions with the State-assigned mediator, EUTA and the District came together June 2nd and were able to amicably settle our impasse without the mediator. As you’ll hear at the Board meeting on June 13, following approval and adoption by the Trustees, EUTA members will be granted one-time compensation for our additional work this past year. We are happy to report that impact bargaining for 2021-22 is officially closed.

Fast Forward to Summer 2022:

Each year, Associations and Districts “sunshine” (“bring light to”) various articles in their joint agreements to negotiate improvements to wages, hours, and working conditions. We call this “Cycle Bargaining,” and it happens annually in all school districts. EUTA and EUSD began our cycle bargaining talks for the upcoming 2022-23 school year on May 25th. Our current contract year ends June 30th, but we intend to continue our talks at least once throughout this summer, and likely into fall. It is not uncommon for chapters to bargain “retroactively” to their prior contracted end date (in this case, July 1, 2022), regardless of when we ultimately come to an agreement.

EUTA updates its slide presentation after each of our bargaining sessions with a recap of the information. If you are reading this, you got here from our QR Code (thank you!). Unlike the District, EUTA is prohibited from using our work email to send clarifying information to parents.

EUTA appreciates your support of our teachers, our students, and our community. We are hopeful that with the generous influx of new money to support education statewide (the new budget should be adopted around June 30th), EUTA and EUSD will be able to collectively move toward more equitable salary, benefits, and working conditions in order to be competitive with our neighboring districts–ultimately, EUTA will continue its efforts to attract and retain the best teachers in Placer County for our children. EUSD has made an initial proposal, and we are currently working this summer on a counterproposal for EUSD in good faith.

In response to the district’s negotiation update, 5/20/2022:

  • We honor the hard work and dedication of our classified colleagues and agree they deserve the $1,000 CM compensation.
    • EUSD Teachers were not offered more one-time money for COVID impact than other districts in the county.
      • Recently, our high school district certificated teachers settled for their 2nd CM compensation of $1800 in only one bargaining session in addition to an 8% salary increase for 2022-2023 school year.
  • FACT: The district in fact DID NOT offer teachers $1000 before impasse was declared.
    • After 4 bargaining meetings from November 2021 to February 2022, the district NEVER countered us with any offer for COVID Mitigation.

After impasse was declared, EUSD made us a confidential offer within the context of impasse, which is protected.

There are rules:

  • One rule is that both parties are prohibited from breaching the confidentiality of any offers made during impasse.
  • EUTA bargainers had already countered the district’s now-public offer, and we are awaiting their counter-proposal this Friday 5/27, in the context of our 3rd mediation.

  • According to the district’s recent email, “EUTA wants to renegotiate a deal they signed last year.”

FACT: EUTA teachers never asked to renegotiate 21-22. EVER. We would never do that. We asked for one-time money for Covid mitigation for 21-22. They did not like our idea but instead of a counter-proposal that they could live with, they simply ignored us, and claimed they were “insulted.”

  • According to the district’s recent email, “By forcing us to impasse CTA/EUTA wants to fast track its ability to advance to fact-finding, agitate its members to work-to-rule, and eventually position its members to authorize a strike in the fall.”

If you were facing the same situation regarding the quality of work-life from November to the Present, what steps would you take?

  • According to the district’s recent email, “We should wrap up this MOU and immediately begin discussing a new successor agreement.”

FACT: EUTA teachers are in complete agreement on this statement. Actually, EUTA/EUSD jointly agreed to negotiate 2022-2023 two days prior to the District “letter.” Regular negotiations have been scheduled for Wed, May 25th since May 18.�

  • According to the district’s recent email, “The District has budgeted for three STEAM teachers to handle TK-3 classroom coverage next year.” The district started by saying “it believes it had a solution for TK-3 prep-time that could have been implemented this year.”
    • Why wasn’t this solution implemented this year? Our 4-6 colleagues were presented with the workable solution of hiring certificated PE teachers. Just ask 4-6 teachers and students how this has improved their learning experience.
    • The challenge of hiring a general science STEAM teacher mid-year was not feasible. Again, while 4-6 colleagues were provided consistent prep, TK-3 teachers were not able to consistently join classes to provide each other prep due to Covid mitigation.

  • According to the district “To be clear the district wants to issue one-time payments to teachers as soon as possible to acknowledge their hard work and dedication during the pandemic and then focus negotiations on salaries for the next year.”

All we are asking is to be FAIRLY compensated for our hard work and dedication.

The last two weeks of school and COVID impact is severe !

  • YES, COVID is impacting teachers right now! We are ending the hardest year ever!

  • From the first day of school this year every teacher’s job was impacted by the demands of COVID.
    • In August our classes began shutting down:
      • Teachers had to create sub plans as they had to be out on COVID mitigation.
      • Teachers taught sick from home due to lack of subs.
      • Teachers had to have Zoom meetings with distance kids while at the same time providing live instruction in class.
      • Teachers designed COVID Mitigation Independent Study Contracts.
        • Three examples as of January 14th 2022: Excelsior -2,385, Oakhills -1845, Cavitt - 725
        • One teacher alone, at Maidu, has had over 150 COVID Mitigation absences.

Negotiations are at an impasse.

TK - 3 Prep Time

From the district’s negotiation update, 5.2.22

“The union contends that resolution of the preparation time issue is tied to an agreement on the one-time payment for 2021-2022.”

  • Our Response: Despite a tentative agreement on TK-3 prep, the district will not agree on the prep time unless we rescind the compensation agreement. EUTA was prepared to sign an agreement in February, but it was the district who insisted that a complete package needed to be presented.
