4.3 IMPROVEMENT TO THE LEGISLATION

  • PLANMalaysia is in the final stage of drafting an amendment for Act 172.

  • 2 new provisions had been proposed to enable SIA implemented in a more inclusive approach that is in line with SDGs.

Proposed Provision 1: Consideration of SIA Report

  • Director General (DG) of PLANMalaysia will be given the power to process and approve SIA reports for project development that need to seek National Physical Planning Council Advice.
  • SIA reports need to comply with specific guideline.

Proposed Provision 2: SIA at State Level

  • State Authority can decide the requirement of SIA for those projects that have social impact at state level.
  • The SIA report have to submit to State Director of PLANMalaysia for approval.
  • PLANMalaysia is in the final stage of drafting an amendment for Act 172 (5 amended existing provisions and 23 new provisions)

  • 2 new provisions had been proposed to enable SIA implemented in a more inclusive approach that is in line with SDGs.

4.1 MONITORING, ENFORCEMENT AND AUDIT OF SIA IN MALAYSIA

Audit penting untuk menilai pematuhan keseluruhan projek dan memastikan langkah-langkah mitigasi adalah berkesan dalam mengatasi atau meminimumkan impak sosial kepada masyarakat sekitar.

Audit tidak diwajibkan, namun ianya boleh dilaksanakan secara sukarela oleh penggerak projek selepas kerja-kerja pembangunan cadangan projek bermula dan diteruskan sepanjang tempoh hayat projek.

Agensi Kerajaan akan menjalankan penguatkuasaan terhadap elemen-elemen sosial berpandukan kepada rangka kerja pemantauan SIMP sepanjang tempoh fasa perancangan, pembinaan, pengoperasian dan projek terbengkalai mengikut peruntukan perundangan dan kuasa sedia ada yang diberikan kepada agensi tersebut.

Audit

Monitoring of mitigation measures shall be fully implemented project proponent after SIA report had been approved.

Monitoring report shall be prepared by project proponent and submit to PLANMalaysia State and local authority every four months.

Government agency, based of the provision of laws and legislation, will carry out enforcement on the social elements based on the social impact management plan framework according to development phase (planning, construction, operation and decommission).

Audit is important to make sure the compliance of implementing mitigation measures to minimize the social impact to the stakeholders.

However, audit is not compulsory. Voluntary audit is welcome for company who want to show compliance to their stakeholders, who expect you to comply with the SIMP.
