  • FAMLI was approved by voters in 2020 and ensures that Colorado workers have access to paid leave during life events that pull them away from work.
  • FAMLI is a social insurance program with both employers and employees contributing to the benefit fund.
  • FAMLI provides workers 12 weeks of paid leave when they are…
    • Caring for a new child during the first year after birth, adoption, or foster care placement.
    • Caring for a family member with a serious health condition.
    • Caring for their own serious health condition.
    • Making arrangements for a family member’s military deployment.
    • Addressing the immediate safety needs and impact of domestic violence and/or sexual assault.

  • As soon as possible: member employers must register for a FAMLI account under their own FEIN (instead of under the PEO’s FEIN) to ensure proper federal taxation of FAMLI benefits.

  • By December 1, 2025: self employed individuals voluntarily participating in FAMLI must upload prior year’s tax transcripts and W2’s; without these, account eligibility moves to “NULL”

  • The Division of Unemployment Insurance (UI) helps people who have lost their jobs by providing temporary wage replacement.
  • Unemployment benefits are funded by employers and help workers pay their bills during job transitions and contribute to the economic stability of the state.

  • As of April 3, 2025, UI is no longer sending employer fact-finding requests in the mail. Employers are now required to respond to Division fact-finding requests by approved electronic means.
  • Accounts with delinquent premiums as of June 30, 2025 are subject to Delinquent Premium Penalty (DPP) assessment. DPP charges are applied each quarter of the following year.

  • Employers and TPAs enrolled in the State Information Data Exchange System (SIDES) can now log-in to E-SIDES from their MyUI Employer+ account.

Division of Workers’ Compensation

  • The role of the DOWC is that of an administrative conservator and regulator of the Colorado workers’ compensation system.
    • In other words, the DOWC’s job is to make sure that the system is operating correctly, all the stakeholders are following the rules to keep the system operating correctly, and to make adjustments to the rules when the system can be improved.
  • The DOWC’s five main external stakeholder groups are injured workers, employers, insurers, attorneys, and medical providers.
  • The DOWC and the insurance carrier are separate entities. The DOWC does not pay benefits.
  • The DOWC also facilitates the process for resolving disagreements between carriers and claimants.

  • A public hearing for Rule 16: Utilization Standards took place on Thursday, May 1, 2025. Another hearing for Rule 2: Workers' Compensation Premium Surcharges was held on May 5, 2025. The DOWC anticipates having rules effective by July 1, 2025.
  • The DOWC has updated Rule 11: Division Independent Medical Examination (DIME) and related forms, effective April 1, 2025, to improve efficiency and fairness in the DIME process. Additional resources and training will be available soon on the DOWC’s website at cdle.colorado.gov/dwc. For inquiries, contact the DIME Unit at cdle_IMEunit@state.co.us or call 303-318-8655.
  • Starting January 1, 2026, all payers (except self-insured employers) must accept electronic medical bills. Providers submitting 25 or more workers' compensation medical bills monthly must use HIPAA-compliant electronic transactions.   • The DOWC is modernizing its claims management system to allow claimants, employers, attorneys, medical providers, and insurers to securely access and manage important information about the status of workers’ compensation claims. The DOWC wants your feedback to ensure the new system improves the user experience and meets your needs.   • The DOWC is encouraging Third Party Administrators, Insurance Carriers, and Self-Insured Employers to register for the EDI Claims Release 3.1 transition.   • The DOWC recently premiered its new Workers’ Compensation 101 for Injured Workers video, available in English and Spanish. The video provides an accessible overview of the claims process, medical care options and employee rights following a workplace injury. While designed to support injured workers, it can also be a valuable educational tool for all stakeholders. The DOWC also offers Workers' Compensation 101 for Employers.     • KNOWLEDGEs: (Knowledge for Workers on Labor Law is Empowering & Drives Good Employment) — one-page summaries for employees on their labor rights.
