INTRODUCTION

  • The Motor Vehicles Act is an Act of the Parliament of India which regulates all aspects of road transport vehicles. The Act provides in detail the legislative provisions regarding licensing of drivers/conductors, registration of motor vehicles, control of motor vehicles through permits, special provisions relating to state transport undertakings, traffic regulation, insurance, liability, offences and penalties, etc.

  • For exercising the legislative provisions of the Act, the Government of India made The Motor Vehicles Act, 1988 The Act came into force from 1 July 1989. It replaced Motor Vehicles Act, 1939 which earlier replaced the first such enactment Motor Vehicles Act, 1914. The Motor Vehicles Act, 1988 is amended by The Motor Vehicles (Amendment) act, 2019.

SHORT EXPLANATION ON DIFFERENT SECTIONS

SECTION.3 - Necessity for driving license.

      • No person shall drive a motor vehicle in any public place unless he holds an effective driving license issued to him authorizing him to drive the vehicle; and no person shall so drive a transport vehicle [other than a motor cab or motor cycle hired for his own use or rented under any scheme made under sub-section (2) of section 75] unless his driving license specifically entitles him so to do.
      • The conditions subject to which sub-section (1) shall not apply to a person receiving instructions in driving a motor vehicle shall be such as may be prescribed by the Central Government.

  • SECTION.4 - Age limit in connection with driving of motor vehicles.
  • No person under the age of eighteen years shall drive a motor vehicle in any public place: Provided that [a motor cycle with engine capacity not exceeding
  • �50cc] out gear may be driven in a public place by a person after attaining the age of sixteen years.
  • Subject to the provisions of section 18, no person under the age of twenty years shall drive a transport vehicle in any public place.
  • No learner’s license or driving license shall be issued to any person to drive a vehicle of the class to which he has made an application unless he is eligible to drive that class of vehicle under this section.

  • SECTION.5 - Responsibility of owners of motor vehicles for contravention of sections 3 and 4.
  • No owner or person in charge of a motor vehicle shall cause or permit any person who does not satisfy the provisions of section 3 or section 4 to drive the vehicle.
  • SECTION.19 - Power of licensing authority to disqualify from holding a driving license or revoke such license.
  • If a licensing authority is satisfied, after giving the holder of a driving license an opportunity of being heard, that he
    1. is a habitual criminal or a habitual drunkard; or
    2. is a habitual addict to any narcotic drug or psychotropic substance within the meaning of the Narcotic Drugs and Psychotropic Substances Act, 1985 (61 of 1985); or
    3. is using or has used a motor vehicle in the commission of a cognizable offence; or
    4. has by his previous conduct as driver of a motor vehicle shown that his driving is likely to be attended with danger to the public; or
    5. has obtained any driving license or a license to drive a particular class or description of motor vehicle by fraud or misrepresentation; or
    6. has committed any such act which is likely to cause nuisance or danger to the public, as may be prescribed by the Central Government, having regard to the objects of this Act; or

  • SECTION.39 - Necessity for registration.
  • No person shall drive any motor vehicle and no owner of a motor vehicle shall cause or permit the vehicle to be driven in any public place or in any other place unless the vehicle is registered in accordance with this Chapter and the certificate of registration of the vehicle has not been suspended or cancelled and the vehicle carries a registration mark displayed in the prescribed manner: Provided that nothing in this section shall apply to a motor vehicle in possession of a dealer subject to such conditions as may be prescribed by the Central Government.

DRIVING LICENSE

A driving license is an official document issued by the government of India, permitting an individual to drive a vehicle on Indian roads. This document certifies that the individual is eligible to drive or ride motorized vehicles such as a car, truck, bike, bus, etc., without any supervision. Commonly referred to as DL, a driving license specifies that you have undergone the required training and tests and are well-aware of all the traffic rules and regulations.

In India, a driving license is issued by the Regional Transport Authority (RTA) or Regional Transport Office (RTO) of the state you reside in. A driving license contains a registration number and a passport size photo that gives you the identity of the owner of the vehicle. It must have a rubber stamp and the signature of the officer-in-charge along with the mention of the office it was issued from. In India, if you are learning to drive, then you should first get a learner's license after which you can get a permanent driving license.

Necessity for driving license

Driving on roads is more like a passion for some, while for the others, it is one of the best means that makes travel easy and comfortable. Being

able to drive on roads gives you the freedom to go wherever you wish to, but you do not get your license to thrill unless you have a valid driving license. In India, for an individual who wants to drive or ride on roads, procuring a driving license is mandatory. The Motor Vehicles Act, 1988 prohibits individuals from driving or riding a motor vehicle without a driving license. The provisions of the act clearly state that no individual is allowed to ride/drive on roads without a valid driving license.

Documents Required for Obtaining Driving License

While applying for a driving license, here is a list of documents that you need to submit:

  • LIC policy bond
  • Voters ID card
  • Ration card
  • Electricity bill issued in applicant name
  • Aadhar Card
  • Passport
  • Temporary address proof (Registered Rental agreement and LPG bill/electricity bill)

Age Proof:

  • Birth certificate
  • Pan card
  • Passport
  • SSC certificate
  • School transfer certificate with date of birth printed on it

Other document requirements for getting a driving license:

  • 3 passport size photographs while applying for a learner's license
  • 3 passport size photographs while applying for a permanent driving license
  • Application fees
  • Duly filled application form
  • For applicants above 40 years, a medical certificate is mandatory

Necessity of registration of vehicle

  • As per the Motor Vehicle Act, all vehicle owners like you must have a valid RC. Only after this will you be able to use the vehicle on the Indian roads.
  • A Registration Certificate is valid for 15 years from the date of issuance.
  • After the expiry, RC can be renewed for 5 years.
  • In case, you own a temporary RC, it will be valid only for a month.

Registration – Where to be made

Whether your vehicle is new or used, you need to visit the local RTO to get the Registration Certificate. It is a feeling of delight when something precious is known in your name.

Documents required for Vehicle Registration Certificate

Getting your vehicle registered is not that a cumbersome job if you own all the essential documents. Here is the list of documents needed for your quick reference.

  • Valid Identity Proof.
  • Purchase Invoice of the Vehicle.
  • Copy of Vehicle Insurance
  • PAN Card copy.
  • Temporary registration issued by the dealer.
  • Registration fees receipt.
  • Form 20.
  • Form 22, Form 22- A i.e. roadworthiness certificate issued by the manufacturer
  • Form 21 - sales certificate issued by a vehicle dealer
