WHAT DO THE NEW EXECUTIVE ORDERS MEAN?

The new administration has put out a lot of new Executive Orders

​

• One result of these orders are increased fear in the community

​

• Important to remember that some changes need to go through Congress or will be reviewed by courts

• Important to understand what the Executive Orders do and don’t mean

​

WHAT DO THE NEW EXECUTIVE ORDERS MEAN?

• This is a constitutional issue that the President cannot change unilaterally, Litigation is pending and has so far been successful in blocking this order

What is it?

• TPS is a temporary legal status given to eligible nationals of designated countries who are present in the United States
• Once TPS expires for an individual, you will no longer have legal status in the United States
• Meet with an attorney to explore possible options to become a Legal Permanent Resident

What is it?

• Parole programs allow individuals to enter the country with a lawful entry and provide eligibility for work authorization while in parole status.

What happened?

• Some of these programs were terminated through executive order in January.
• Termination of the program for Cuban, Haitian, Nicaragua and Venezuela was announced recently and is scheduled to end on April 24, 2025.

What is it?

• New online program to “register” if you haven’t done so already (some individuals registered when they apply for an immigration benefit)
• You are “registered” if you are in immigration court, have a work permit or a green card

What does it do?

• It does not provide for an immigration status or for eligibility for work authorization
• If you register, you may increase your risk of being detained or deported.
• If you register, you may be protected against criminal charges of “failing to register” or “failing to carry evidence of registration”

WHO MAY BE AT HIGHER RISK FOR DEPORTATION?

Some undocumented individuals are at higher risk for deportation than others. Those include:

• You did not file an application with the court

• Having a deportation order means that the person can no longer be in the U.S. and cannot return to the U.S. for a period of time (typically 10 years).

• You will no longer have hearings with the immigration judge.

​

​

• You can receive an order in person or by mail.

​

​

• If you have an order and are detained by ICE, you do not have the right to see an immigration judge.

You don’t have to open a door unless there is a judicial warrant (which ICE typically does not have)

Never give any false documents to ICE.
