IMMIGRANT AND REFUGEE RIGHTS
“Immigrant” and “refugee” are often used interchangeably, it is important to distinguish these terms, which have important legal differences.
A refugee is a person who leaves his/her country because he/she is at risk of serious human rights violations and persecution.
These are people who are faced with the threat of security and danger to their lives, for whom they have no choice but to leave their country and seek refuge in another country.
Immigrants are people who live outside their home country but are not asylum seekers or refugees.
Some immigrants leave their country to work, study or live with family members abroad. Some feel the need to leave their country because of poverty, political turmoil, gang violence, natural disasters or other harsh conditions.
An asylum-seeker, an asylum seeker is a person who has left and has sought refuge in another country to be protected from persecution and severe human rights protection, but the immigrants are not recognized as asylum seekers and the consequences of asylum are expected.
WHAT ARE REFUGEE RIGHTS
Refugee rights refer to the international protection provided to these people by international law if the states do not fulfill their obligation to protect their citizens due to various reasons such as war and internal turmoil.
States must protect all immigrants from racist and xenophobic violence, exploitation and forced labor.
States do not have an obligation to provide a permanent solution to refugees, and the United Nations High Commissioner for Refugees (UNHCR) is responsible for finding a permanent solution and organizing the necessary organization to ensure the integration and education processes of refugees.
Refugees are recognized in the GENEVA CONVENTION:
States will cooperate internationally on refugee rights.
The prohibition of refoulement is important in the context of the prohibition of torture, which is a fundamental principle. The prohibition of torture has been protected by many international texts and constitutionally in our domestic law. In refugee law, the return of refugees to their countries of origin where they are at risk of torture would naturally conflict with the international protection afforded to them for the protection of their right to life and bodily integrity.
Articles of the Universal Declaration of Human Rights
According to Article 14 of the Universal Declaration of Human Rights, everyone has the right to seek and to enjoy asylum. The declaration is regarded as a milestone in international human rights law.
Human rights are inseparable and interlinked. The right to asylum is worthless if other human rights of asylum seekers are not respected, and refugees should not have to accept infringements of their privacy rights any more than anyone else.
