US Forest Service Acknowledgement of Risk

I recognize that there are risks inherent in any adventure, sport, or activity associated with the outdoors. On behalf of my heirs, legatees and myself, I specifically acknowledge the risks and dangers inherent in Nordic skiing and ski instruction, and have been informed of and have independently investigated the risks associated with Nordic skiing and ski instruction. For myself, my heirs and legatees, I understand that the risks inherent in Nordic skiing include, but not are not necessarily limited to the following:

1. The nature of the activities themselves, skiing, racing, training and travel and any combination thereof;

2. Acts or omissions or negligence of any kind or nature whatsoever by the Peak Performance, its agent or employees, its officers or directors, or other persons or entities acting on behalf of the Peak Performance;

3. The acts of other participants in these activities, including but not limited to Peak Performance clients and employees;

4. Weather conditions;

5. Contact with plants or animals;

6. My own physical condition, or my acts or omissions;

7. The condition of roads, trails, waterways, or terrain, and accidents connected with their use and the use of vehicles of approach including, but not limited to, land vehicles, aircraft, fixed and rotary wing;

8. First-aid, emergency treatment or other services rendered;

9. Consumption of food or drink; and

10. Encounters with snow grooming equipment.

I understand that the above list is not exhaustive or complete, and that other risks, known or unknown, identified or unidentified, may also result in injury, death, illness or disease, or damage to my property. I understand that injuries from the risks associated with Nordic Skiing may include mental or physical injuries or even death.

Therefore, I assume full responsibility for personal injury to myself and/or to members of my family, or for loss or damage to myself, my family members and guests and our personal property and expenses thereof as a result of my family members or guests participating in Nordic skiing, guiding and/or instruction..

I have read, understand, and accept the terms and conditions stated herein and acknowledge that this Acknowledgement of Risk shall be effective and binding my heirs, my legatees and myself during the entire period any of us engage in Nordic skiing.

I understand and acknowledge that by initialing and signing this document I have given up certain valuable legal rights and/or possible claims which I might otherwise assert or maintain against the Peak Performance, its agent or employees, its officer and directors, and other persons or entities, including its members, including, but not limited to, rights arising from the acts or omissions and negligence of any kind or nature whatsoever of the Peak Performance, its agent or employees, and all persons or entities.

I understand and agree that any legal disputes arising out of this agreement is to be adjudicated under the laws of the State of Wyoming in a Wyoming court.

It is further understood and agreed that, if any court should vacate or strike any portion of this agreement, such actions shall not affect any other portion of the agreement.

THIS RELEASE INCLUDES SPECIFICALLY, BUT IS NOT LIMITED TO, NEGLIGENCE OR ACTS OR OMISSIONS ON THE PART OF PEAK PERFORMANCE, ITS AGENTS OR EMPLOYEES, ITS OFFICERS AND DIRECTORS, ITS MEMBERS, OR ANYONE ACTING ON BEHALF OF PEAK PERFORMANCE.

I further agree to hold harmless and indemnify Peak Performance, its agents and employees, its officers and directors, its members, from any claims or causes of action of any kind or nature whatsoever caused or occasioned by my participation in events sponsored by or organized by in whole or in part by Peak Performance.

I hereby agree not to maintain any cause of action of any kind or nature whatsoever against Peak Performance, and agree to indemnify Peak Performance for any damages, including attorney's fees and costs occasioned by any action prosecuted on my behalf against Peak Performance, its agents or employees, its officers and directors, or its members.

I understand this agreement is the entire agreement between me and Peak Performance and that it cannot be modified or changed in any way by the representations or statements of any employee or agent of Peak Performance or by me.
