LIABILITY WAIVER AND RELEASE OF CLAIMS

This Waiver and Release of Claims ("Agreement") is entered into on this date by and between:

Chocolate Milk Chuggers
(Hereinafter referred to as "Club")

AND

Participant
(Hereinafter referred to as "Participant")

1. Acknowledgment of Risk:
The Participant acknowledges that participation in the activities of the Club, including but not limited to running, training, and events, involves inherent risks that may result in injury, illness, or even death. The Participant voluntarily assumes all risks associated with participation.

2. Release of Liability:
In consideration for being allowed to participate in the activities of the Club, the Participant, on behalf of themselves and their heirs, executors, and assigns, hereby releases, waives, and discharges the Club, its officers, members, and agents from any and all claims, liabilities, injuries, or damages arising out of or related to the Participant's involvement in Club activities.

3. Indemnification:
The Participant agrees to indemnify and hold harmless the Club from any claims, damages, losses, or expenses, including attorney's fees, arising from the Participant's conduct or participation in Club activities.

4. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of the state of Michigan.

5. Severability:
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.

6. Entire Agreement:
This Agreement constitutes the entire understanding between the parties concerning the subject matter hereof and supersedes all prior agreements or understandings.
