RELEASE OF LIABILITY & USE OF IMAGE

BY AN ADULT PARTICIPANT (or parent/legal guardian if participant is a minor)

The participant (or the parent/legal guardian if the participant is a minor) must read and understand this document before signing. In consideration of my participation in the Friends of Runyon Canyon Foundation program identified as (the “Program”), I state and agree as follows:

I agree to follow the instructions of the Program Leader(s) named above. I have been instructed in and understand the use of equipment I am to use. I understand that there are possible dangers associated with the Program, including but not limited to, by way of example only and without limitation: uneven or rugged terrain, slippery rocks, plant spines, yellow jackets, bees, potential failure and/or malfunction of my own or others’ equipment, and hot sunny conditions. I understand that my participation in the Program may involve sustained strenuous physical activity. I am in good health and am aware of no physical problem or condition that will limit or interfere with my ability to participate in the Program.

By my signature, I hereby state that I understand the risks involved in participating in the Program and willingly and voluntarily accept these risks. By my signature, I hereby surrender any right to seek reimbursement from Test Plot and Friends of Runyon Canyon Foundation, and their respective directors, officers, employees, volunteers and other agents for illness or injury sustained and liability incurred during my participation in the activity described above. 

By my signature, I warrant that I am not relying on any oral representations, statements or inducement apart from the statements made on this form.

I expressly release and hold harmless Test Plot and Friends of Runyon Canyon Foundation, and their respective officers, directors, employees, and agents from and for any and all claims, demands, actions and causes of action whatsoever including claims for (i) libel, defamation, invasion of privacy or right of publicity arising from Test Plot or Friends of Runyon Canyon Foundation use of my appearance, name, likeness, voice and biographical information, including but not limited to, the distribution, reproduction or broadcast of the photographs (or any part thereof) or (ii) any loss, damage or injury to person or to property suffered or incurred by me in connection with the Program or any aspect of it, including, but not limited to, any transportation arranged by, paid for, or provided by Test Plot. 

By signing below, I acknowledge that I have thoroughly read and understand this form and that the statements I have made are all true, and I consent to the terms of this waiver agreement. I Hereby Execute This Agreement On Behalf Of Myself (And My Child). I Declare That I Have Been Given Full Opportunity To Read This Agreement, That I Understand It And Am Executing This Document Voluntarily, Freely And Knowingly, Without Reliance On Any Representations Or Other Statements Of The Co-Sponsors Or Others. I Agree That The Terms Of This Document Are Binding On Me (And My Child), My Heirs, Next Of Kin, Executors, Administrators, Legal Representatives And Assigns (And The Heirs, Legal Representatives And Assigns Of My Child).
