1. CANDIDATE REQUIREMENTS
Eligibility *
Requirements to be a candidate for a NSW State Election are set by the NSWEC and can be viewed hereTo be eligible to nominate as a candidate for the state election, you must be:
  • at least 18 years old and enrolled to vote for any district in New South Wales.
You may not nominate as a candidate if you are disqualified, for example, if you are:  
  • a member of the other House
  • hold or benefit from a contract with the public service, (with certain exceptions)
  • hold an office of profit under the Crown or have a pension from the Crown
  • a Member of the Commonwealth Parliament.

You may be required to provide a number of documents before you can be endorsed as a candidate. These include but are not limited to:
  1. ID Document - a birth certificate, passport, driver's licence or other photo identification document.

  2. National Police Check - this will cost $55.80 and can be obtained here.

  3. Working With Children Check -  this can be obtained here and will require a visit to Service NSW.

Nomination Deposit *
The NSW Electoral Commission requires a nomination deposit of $250 to be a candidate in the State Election. The Party may assist candidates in covering this expense but it remains the responsibilty of the candidate. The payment will be due to the Party upon endorsement as a candidate. The Party will then make the payment of the nomination deposit to the NSWEC on behalf of the candidate when nominations are submitted.

The portion of the nomination deposit paid by the candidate is reimbursed by the Party if a candidate meets the following criteria otherwise the nomination deposit is forfeited:
  • is elected
  • has received at least four per cent of the total number of formal first preference votes
  • dies before election day
  • withdrew the nomination before 12 noon on the nomination day
  • had their nomination rejected due to it being incomplete at 12 noon on the nomination day

The below code of conduct is to ensure we set a high professional standard for our candidates and that messaging across our campaign aligns with our Party's principles. The below requirements are in addition to the overall party code of conduct that can be read here.

  2. I have read and agree with (or am not strongly opposed to) the policies of the Party. To read our Party's policies click here.

  3. I will promote the objectives, principles, and policies of the Party, and will comply with the Party Constitution and any lawful directions from the Party.

  4. I will abide by the decisions of the Party in relation to relevant electoral legislation and will sign any forms that may be required by such legislation.

  5. I am willing and eager to cooperate with the Party throughout the duration of my campaign in regards to receiving instructions and advice.

  6. I will adhere to set campaign schedules, be punctual, and dedicated to the campaign's goals and events.

  7. I understand and agree that my campaign materials and any public statements made by me in the capacity of a candidate must be relevant to the campaign and align with the party's principles and policies.

  8. I understand and agree that bullying, harassment and impropriety towards other candidates, members of the party or the general public, may result in my disendorsement as a candidate of the party.

  9. I will seek instructions and advice from the Party before making any public statements that come into conflict with the Party's policies.

  10. I agree that I will not post any material that contradicts the party's principles or policies on social media in the capacity of a candidate.

  11. I agree that I will not post inappropriate material on social media that may bring the party into significant public disrepute.

  12. I agree to abide by any rules or regulations required by the NSW Electoral Commission and am willing to do what is required of me to ensure successful nomination as a candidate.

  13. I am willing to provide further information in regard to my campaign and personal conduct throughout the campaign if requested by the Party.

  14. I am willing to participate in regular communications and training sessions with the Campaign Committee.

  15. I am willing, where required, to attend candidate information sessions hosted by the NSW Electoral Commission.

  16. I agree that any data shared with me will not be shared with anyone outside the Campaign Commitee and will only be used for the intended purpose for which it was given to me.

  17. I agree that any preference negotiations I have with other candidates or parties will be done in collaboration with the Campaign Committee, should align with the party's principles and policies, and should strive to not bring the party into public disrepute.

  18. I will only present myself as a candidate of the Party from my endorsement up to, and including, the day of the election. I will seek written permission from the Party should I wish to continue to be a representative of the Party after this period.

Social Media *
1. PURPOSE AND SCOPE

This policy outlines the guidelines and expectations for candidates running in a State Election regarding their use of social media. It aims to ensure that all online activity aligns with the values of the Party and complies with legal and ethical standards.

2. GENERAL CONDUCT
  1. Respect and Civility: Candidates must engage respectfully with everyone, including constituents, other candidates, media, and the general public. Personal attacks, discriminatory remarks, or any form of harassment are strictly prohibited. Additionally, candidates are responsible for monitoring and managing any content posted by followers on their social media channels.
  2. Accuracy and Honesty: Information shared on social media must be accurate, truthful, and not misleading. Candidates should avoid spreading rumours, unverified claims, or false information. Corrections should be made promptly if misinformation is identified.
  3. Confidentiality: Candidates must not disclose any confidential information or internal Party matters on social media. Sensitive information related to the campaign, Party strategy, or personal data of constituents or supporters must be kept private.
3. COMPLIANCE WITH LAWS AND REGULATIONS
  1. Electoral Laws: All social media activity must comply with standards outlined by the NSW Electoral Commission.
  2. Account Authorisation: The Party authorisation line must be visible on all candidate social media accounts.
  3. Content Authorisation: During the campaign period, all branded content is legally considered political advertising. Ensure all posts, videos, and ads include the correct Party authorisation line.
  4. Paid Social Media Advertising: Candidates may use social media to advertise themselves or Party policies. All ads must be approved by the Party prior to running.
  5. Facebook & Instagram Advertising Disclaimer: Facebook and Instagram political advertising in Australia must be declared and include a disclaimer. Ensure your page is set up with the Party disclaimer, and all advertising is marked as "special ad category," indicating it contains social or political content.
  6. Memes: Unbranded posts, page shares and memes are not classed as political content. These posts will not require an authorisation line or disclaimer.
  7. Defamation and Libel: Candidates must avoid making defamatory statements about individuals, organisations, or other parties. Legal action can be taken against those who publish false or damaging statements.
  8. Copyright and Intellectual Property: Respect the intellectual property rights of others. Do not post copyrighted material without permission or proper attribution.
  9. Social Media Channels: Abide by the terms, conditions, conduct and community standards outlined by the social media platform in use.
4. SOCIAL MEDIA TONE
  1. Positive Representation: Candidates should represent the Party's values and policies in a positive light. Content should aim to focus on Party policy, campaign updates, and constructive dialogue with constituents.
  2. Engagement and Responsiveness: While it's important to engage with followers and respond to questions or concerns, candidates should do so thoughtfully and avoid getting drawn into unproductive or hostile exchanges.
5. CRISIS MANAGEMENT
  1. Addressing Controversy: Should you become involved in a social media controversy, please seek guidance from the Party before responding. Swift, transparent, and measured responses are crucial in managing public perception.
  2. Trolls: Candidate pages may attract trolling. If this happens, don’t take it personally. To handle trolls, you may:
    i. Delete comments or
    ii. Hide comments (the troll may not know their comment is hidden, making this a more effective approach).
  3. Account Security: Candidates are responsible for securing their social media accounts. You may add content creators and admins but keep this to a minimum. Use strong passwords, enable two-factor authentication, and remain vigilant against phishing and hacking attempts.
6. SOCIAL MEDIA CHANNELS
  1. Candidates are encouraged to engage across various social media channels, such as Facebook, Twitter, Instagram, Telegram and TikTok to reach a broader audience and maximise your campaign's impact. Please consider the demographic and target market differences in platforms and adapt your content to suit.
  2. Competitors: Research and follow your political competitors, this may help you develop an understanding of what is resonating with voters in your electorate.
7. PERSONAL VS. CAMPAIGN ACCOUNTS
  1. Clear Distinction: Candidates should maintain a clear distinction between personal and campaign-related social media accounts. Personal opinions shared on private accounts should be clearly distinguished from official campaign positions.
  2. Content Sharing: Avoid sharing content on personal accounts that could reflect negatively on the campaign or the Party. Even on personal accounts, candidates are expected to uphold the Party’s values.
8. ACCOUNT CREATION
  1. If needed, the Party may create social media accounts for you. During the campaign, you will be given content creation rights and the ability to add helpers to manage your account. Accounts created by the Party will remain the property of the Party.
9. PRE-EXISTING OR CANDIDATE CREATED SOCIAL MEDIA ACCOUNTS

Candidates who create their own accounts or choose to use their existing social media accounts may use them for the duration of the campaign if they:
  1. Get clearance from the Party.
  2. Ensure previous content complies with Party guidelines.
  3. Change existing account names to reflect the campaign.
  4. Follow NSWEC and Party policies, including required authorisations and disclaimers.
  5. Post-Campaign Requirements: If unsuccessful, you must delist your social media channel or remove all Party name references from your accounts within 21 days of the completion of the campaign. Successful candidates may continue using these social media accounts for their term as an elected representative of the Party.
  6. Grant administrator access to the Party for the duration of the campaign. This is so abandoned or neglected accounts can have Party references removed post-campaign. The Party will not in any circumstance assume ownership of the account.
10. MONITORING AND ENFORCEMENT
  1. Page Admins and Content Managers: You may enlist help to assist with managing questions and comments on your page. Volunteers or paid employees working in this capacity must also adhere to the Party social media policy.
  2. Regular Monitoring: The Party will regularly monitor candidates' social media activity to ensure compliance with this policy.
  3. Violations: Any violations of the policies outlined in this document may result in disciplinary action, including, but not limited to, delisting social media channels or other sanctions as determined by the Party.
11. SOCIAL MEDIA COMMENTARY:
  1. Commenting on Other Pages: As a candidate, you are encouraged to comment on other social media pages to increase your visibility and engage with constituents. Focus on relevant Party policies and adhere strictly to the code of conduct.
12. SOCIAL MEDIA CONTENT
  1. Content: The Party may provide a base level of branded Party content for the duration of the campaign. Candidates may choose to have this content added automatically to their accounts through the Party’s social media management tool.
  2. Party Assets: Candidates will have access to a library of Party assets for the duration of the campaign. Additional campaign marketing material created or distributed by candidates must adhere to the Party Brand Guide to ensure a uniform and professional image.
  3. Canva: Candidates and/or their helpers are encouraged to sign up for a free Canva account. Party assets such as fonts and templates may then be shared with candidates and their team for the creation of additional social media content.
  4. Support: Candidates may seek support from the Party for advice on social media strategies, content creation, and crisis management. If you’re unsure about content, please check prior to posting.
13. CONCLUSION

Candidates are representatives of the Party and should use social media in a way that positively reflects the Party’s values and goals. By adhering to this policy, candidates will contribute to a respectful and effective campaign, enhancing the Party's reputation and electoral success.

Campaign Finances *
The NSWEC's financial compliance rules are extremely complex and strict. You can read all about them here. The below requirements are to ensure the Party and its candidates remain legally compliant with all campaign donations and expenditure. 

Donations and Expenditure
  1. All campaign donations and expenditure must go through the Party's campaign bank account. The Party will not be legally liable for any fines due to campaign donations received or expenditure paid outside of the Party's financial systems and processes.

  2. A report is provided to candidates throughout the campaign that shows income and expenditure attributed to their electorate.

  3. Candidates are required to provide receipts of all campaign expenditure.

  4. If required, candidates can make personal contributions to the Party campaign account to cover any campaign expediture.

  5. Candidates who run an active campaign can expect to spend a certain amount on campaign expenditure (eg. merchandise, flyers, advertising, etc.). The total campaign expenditure can range from $1,000 up to, and potentially more than, $10,000. The cost will vary depending on the amount of marketing you do, the duration of your campaign, and the number of volunteers in your team.

  6. The Party may assist you with the cost of campaign expenditure as well as provide graphic design and IT systems support. But campaign expenditure will remain the primary responsibility of the candidate unless otherwise agreed in writing by the Party.

  7. Should the Party pay any campaign expenditure on behald of a candidate it shall immediately become a debt due and owing by the candidate to the Party and recoverable against the candidate by the Treasurer on behalf of the Party.

  8. A candidate must not pledge the credit of, or incur any debt or liability whatsoever in the name of or on account of, the Party during the campaign.

  9. A candidate must not accept any donation from any person or organization, which imposes on them a guarantee, pledge, or undertaking.
Election Campaign Funding
  1. Campaign expenditure will be reimbursed to a candidate up to 100% of their total campaign election funding entitlement for their electorate.

  2. The total campaign election funding entitlement amount is determined by the NSWEC. For more information on election campaign funding click here.

  3. Campaign expenditure that is deemed eligible for reimbursement will be at the discretion of the NSWEC.

  4. The Party will not take responsibility for campaign expenditure that is not reimbursed due to inadequate accounting records being kept or is deemed ineligible by the NSWEC for election campaign funding.

  5. A candidate that is disendorsed by the Party will not be eligible for reimbursement of campaign expenditure.

5. SUBMIT APPLICATION

  1. I submit my name for selection and endorsement as a candidate of the Party voluntarily, of my own free will, and without any inducement, promise, warranty, representation, statement or information of any kind or nature by the Party or any person on behalf of the Party.

  2. My candidate application has been prepared by me personally and all the information provided, to the best of my knowledge, is true, correct, and complete in all respects.

  3. I will not make any public or media statements in relation to my application for candidacy without prior approval from the Party.

  4. I consent to the Party, or their appointee, undertaking any investigations or verifications in relation to my candidate application.

  5. I agree to supply to the Party any further information that may be requested of me.

  6. I will accept and abide by the decisions of the Party as having been made in the best interests of the Party.

  7. If I am not endorsed as a candidate:

    a. I will accept that such a decision will not in any way reflect adversely on my character or integrity, and that I shall have no cause for complaint.

    b. I will not contest the election or in any way support any candidate or party in opposition to the Party endorsed candidate unless I have written permission from the Party.

    c. I will not engage in any conduct designed to or having the effect of disparaging the Party endorsed candidate or the Party, or engage in any other conduct which may adversely impact upon the electoral prospects of the Party or the Party endorsed candidates.

    d. I will not take legal action against the Party or any person selected as a candidate in connection with the selection process.

    e. I will not bring the party into disrepute nor disclose the nomination process with anyone outside of the State Executive or Campaign Committee.

  8. I accept that any violation of the above declaration or candidate requirements outlined in this application may lead to my disendorsement as a candidate, disciplinary action, or expulsion from the Party under the Party Constitution and By-Laws, and render me personally liable for any expenses incurred by the Party in the promotion of my campaign.
