Agreement

By submitting this form, you agree to the following:

Information. That all the information provided is accurate and that you are willingly offering your time and services as a volunteer. The shifts you select on this form will be your scheduled times.

Scope of Services. That you will be providing your services at the HorrorHound Weekend event without compensation.

Agency. That you are not an employee or agent of any sort of HorrorHound. You are referred to as a “volunteer” and will offer to perform as a volunteer on your own volition and will hold yourself out to the public, not as an employee or agent of HorrorHound, but as a contracted volunteer. You further understand that I or HorrorHound can terminate this relationship at will.

Ownership of Rights. All such works performed during such dates shall be deemed to be “works” of which HorrorHound shall be deemed the author under United State copyright laws. To the extent necessary to effectuate the foregoing you hereby assigns and agrees to assign to HorrorHound all such rights and agrees to provide such reasonable assistance as may be necessary to perfect HorrorHound rights hereunder. You also grant to HorrorHound a perpetual, fully paid license to use and grant third parties rights to use any ideas, videos, graphics, writings, pictures and other imagery provide by you as part of Services delivered hereunder, even if not developed in the performance of Services.

Term and Termination. This Agreement will remain in effect during all of your scheduled hours throughout the aforementioned HorrorHound Weekend, whichever is earlier. All resulting copyrights obtained during the event however, shall remain as stated under Ownership of Rights.

Confidentiality. You will maintain confidentiality and not disclose any information regarding trade secrets, development plans, proprietary information, techniques, business plans, customer lists, prospects and other matters which are not generally known relating to HorrorHound or its Clients or prospective Clients (“referred to as Confidential Information”). It is agreed that all Confidential Information, whether produced by you or by others, is and shall remain the property of HorrorHound. You agree that you will hold all material that is identified as Confidential Information in strict confidence and will not use such material for its own benefit. In the event of a breach of confidentiality by you, you agree to be responsible to HorrorHound for all damages, costs, and liability for said breach. Said confidentiality shall remain in effect indefinitely.

Relationship. Nothing in this Agreement will constitute any contract of employer/employee relationship between you and HorrorHound other than that of a volunteer and neither party is authorized to bind the other in any way. You are obligated to comply with all legal requirements (including without limitation those relating to tax withholding and worker’s compensation insurance) applicable to all employers and to maintain in effect general liability insurance coverage. You further authorize HorrorHound to seek emergency medical treatment on your behalf in case of injury, accident or illness while volunteering and you understand that you will be responsible for medical costs incurred for said treatment.

Compensation. You agree to provide services without compensation.

Indemnification and Hold Harmless. You agree to indemnify and hold harmless HorrorHound from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney fees in connection with or arising out of or resulting from my participation as a volunteer and to reimburse HorrorHound for any expenses incurred by HorrorHound as a result thereof.
