DOG SUBJECT TO THIS AGREEMENT IS A
Ownership shall remain with the breeder untill the breeder transfers ownership in writing to the guardian at the conclusion of this contract. Likewise, any puppies born to a female dog or any semen from a male dog shall be the SOLE and SEPERATE property of the breeder and the guardian shall have NO ownership or possession rights to them, or any use of the semen. Upon completion of this contract breeder will pay to have dog spayed or neutered and transfer possesion to guardian. Guardian shall then continue to house and love the dog for the rest of its life in accordance with this contract.
While the guardians have the dog the breeder shall provide the following.
1- Dietary guidlines and instructions for the healthcare of the dog, including but not limited to, acceptable high end grain free food, worming and vaccination information, appropriate chew toys and other toys.
2-Visit the home of the guardian at least 4 times a year at prearranged times. Unannounced visits may occur as well.
3-Approve of a veterinarian to provide medical care to the dog while in guardians care.
4-Training on recognising when a female comes into heat(season) with approxamate times when to expect this.
5-Time for collection of semen or mating if the dog is male.
6-Information on how to care for and what to expect from a pregnant female.
7-Pay for all veterinarian expences related to breeding. (DNA health testing, DNA profiling, hip and elbow xrays, ect)
8-If the dog is a female, the breeder will take possession of her for a week during the heat cycle for breeding, then she will be returned to the guardian for her gestation period (pregnancy). The breeder shall again take possession of the dog a week from her due date and she will remain with the breeder untill her puppies are welped and weaned (aprx 5-7 weeks)
9-If the dog is a male, the breeder will take possession of the dog at the appropriate times for collection of semen or same day breeding at guardians's home. Additionally, breeder will take possession of the dog up to 7 continuous days each time for breeding to be done at the breeders home.
10-Allow guardian to come to breeders home to soothe and console dog during welping if guardian desires.
While the guardians have the dog they shall provide the following.
1-Safely confine the dog by a traditional fence and restraining the dog by a leash anytime the dog is outside the guardians home or yard, especially during the females heat cycle or anytime with a male. Once the dog has been trained to respond to voice commands then off leash retrieving for exercise is permitted except during a females heat cycle. A female may not be left outside in the yard of the guardians home, or any home during her heat cycle (heats last approximatly 3 weeks, no more than 2 times a year). At this time a female must be left inside the home and away from other dogs, or inside a crate or secure garage.
2-Provide plenty of exercise for the dog on a dailey basis.
3-Provide basic obediance training, either with a trainer or at home. Basic obedience includes, but not limited to: sit, stay, come, down, walking on a leash, potty training and socialization.
4-Follow all dietary guidelines as recommended by breeder.
5-Provide regular vaccinations and rabies, provide monthly flee, tick and heartworm medications, provide vet care as needed all at guardians expense. Guardian must immediately provide breeder the dates of treatments and any vet care for breeders records.
6-Consult breeder at first sign of any illness or injury and pay for any vet visit due to illness or injury while in guardian's care. This includes severe diarrhea, loss of appetite, vomiting, anything out of the normal behavior of the dog.
7-Use only the approved vet unless an emergency situation dictates otherwise.
8-Deliver dog to breeder or meet breeder upon request with 24 hour notice for breeding, testing, etc.
9-Notify breeder of any scheduled vacations or other times that the dog will need to be cared for by someone other than guardian. The breeder must be given the contact information and approve the caretaker during absence. The guardian must schedual and pay for boarding expenses that may be necessary if the breeder is unable to care for the dog while the guardian is out of town. Guardian shall notify breeder of vacation plans if the dog will be with the guardian on vacation, and provide all contact information in the event the dog is needed for breeding during vacation time.
10-Keep dog licence current with the county they live in.
11-Maintain a principle place of residence within a 150 mile distance of Paonia Colorado (unless otherwise and specifically agreed upon by breeder). Guardian must provide a current and accurate address, phone number and email.
12-Keep dog well groomed at all times. Poodles need regular brushing to prevent matting. guardian must use a groomer experienced with poodles when needed every few months to keep hair healthy and well maintained. Guardian will discuss with breeder before having dog shaved down in a field cut.
13-If dog is a female, deliver dog to breeder 5-7 days before her due date.The dog will remain with the breeder untill her puppies are weaned (5-7 weeks). She will then be returned to guardian. Breeder will decide how many litters the dog will have after seeing how she is as a mother and how she tolerates pregnancy, labor and the weeks following delivery of her puppies.
14-If the dog is a female and there is a problem with a pregnancy that endangers the health of the mother and breeders vet thinks the issue will again arrise with her next litter, no future breedings will be required, the dog will be spayed as soon as medically appropriate, and ownership transfered to guardian.
REMOVAL OF DOG
The breeder may remove the dog from the guardian for non-compliance of the terms of this agreement, at which time this agreement shall terminate. Breeder agrees to consult with guardian before permanently removing dog from guardian's possession unless, in the breeders judgement the dog must immediatley be removed in order to protect the health, welfare and safety of the dog. If the dog does not need immediate removal then the breeder shall give the guardian a reasonable amount of time to comply with breeders requirments for maintaining the health, welfare or safety of the dog before permanetly removing dog.
REMOVAL OF STUD DOG
Breeder may immediately remove a stud dog should the guardian hire out the stud, or sell his semen, without specific written permission from the breeder. If this occurred, the guardians will also pay the breeder $2,500.00, the value of said stud service or semen.
DEATH OF DOG
Should the dog die from natural or accidential causes, that are not considered negligence, This agreement shall terminate and neither party shall a have any further obligation to the other party. (non compliance of using a leash or keeping the yard fence in good repair and gate closed is considered negligence). Should the dog die during welping then the breeder has the option of providing a puppy from that litter if any survive to the guardian.
TRANSFER OF OWNERSHIP
At the sole and absolute discretion of breeder, when the breeder decides that the dog either a potental breeder/sire or proven breeder/sire is either unable to be used for breeding purposes or finished being used for breeding purposes then the breeder shall have the dog spay/neutered and transfer ownership to guardian.
RETURN OF DOG
During the term of this contract, Guardian may permanantly return the dog to breeder for any reason, at that time this contract is terminated.
IMMEDIATE PAYMENT TO BREEDER
If, before transfer of ownership to the guardian, any of the following happen, the guardian agrees to pay the breeder the sum of $15,000.00
1-if guardian, independently and without written concent of the breeder, has the dog spayed/neutered.
2-Guardian intentionally causes injury to the dog or intentionally or out of negligence causes the death of the dog.
3-Guardian absconds with the dog, fails to advise breeder of any and all changes in guardian's address or ceases communication with breeder.
This agreement shall not be transferred to another breeder or guardian in whole or in part without prior written agreement.

THIS CONTRACT WILL BE SIGNED BY BOTH PARTIES AND NOTARIZED BEFORE DOG WILL BE PLACED WITH GUARDIAN. ALSO LISTING COLOR, SEX, DOB, MICROCHIP NUMBER OF DOG TO BE PLACED WITH GUARDIAN.
