*WATERFALL ELOPEMENTS AT KULANIAPIA FALLS are at the rate FOR COUPLES (2) + 4 Guests. Additional Guests incur a fee of $100 per person. No more than 6 guests are permitted to attend.
Waterfall Weddings AT KULANIAPIA FALLS are RAIN OR SHINE. Refunds will not be given for any reason due to weather. Officiant does their best to work with Couple to ensure requests are met. Rain is possible at this location.
2. All weddings except Simple Weddings, require a 50% non-refundable deposit. Simple weddings, vow renewals, and private venue weddings, at the rate of $495, require a $495 non-refundable deposit. This deposit covers Couple's date and time which would otherwise be available to other clients. The deposit will be applied toward the total amount billed. Balance is due TEN (10) days before wedding date.
3. This deposit is non-refundable for any circumstances including rescheduling, cancellations, emergency, casualty, injury, acts of God, nature or terror, or other cause beyond the control of the parties. Should Couple choose to cancel wedding and forfeit deposit, no liability will be held against Officiant. Couple agrees that no further damages may be sought against Officiant or any persons affiliated with Officiant.
4. CANCELLATIONS + RESCHEDULES: All cancellations must be made within 10 days prior to wedding. Deposits are non-refundable for any and all circumstances. Should Couple have any of the above circumstances and need to reschedule wedding, Officiant will allow Couple to reschedule services and apply deposit for up to ONE (1) years from selected wedding date. Couple must notify Officiant in writing of reschedule within SIXTY (60) day of cancellation with new wedding date, subject to Officiant's availability. Couple will be charged at rate of booking upon newly scheduled wedding date and may be subject to an increase in pricing. Should couple decide to cancel wedding entirely, deposit is non-refundable.
5. Couple must pay balance TEN DAYS (10) before wedding date. Failure to pay the selected service amount, in full when due, will release Officiant from providing any services under this agreement.
6. Should Couple cancel wedding within TEN (10) days of wedding for any reason including rescheduling, cancellations, emergency, casualty, injury, acts of God, nature or terror, or other cause beyond the control of the parties, Couple will forfeit 100% of balance to Officiant. Couple agrees that no further damages may be sought against Officiant or any persons affiliated with Officiant.
7. Should Couple have any of the above circumstances and need to reschedule or cancel wedding, Officiant will allow Couple to reschedule services and apply deposit (50% of wedding payment) for up to ONE (1) years from selected wedding date. Couple understands that remaining balance will be forfeited and understands that in this time frame many services have already been booked and rendered. Couple must notify Officiant in writing of reschedule within SIXTY (60) day of cancellation with new wedding date. Couple will be charged at rate of booking upon newly scheduled wedding date and may be subject to an increase in pricing.
8. Last minute elopements and weddings must be paid in full. If a last minute wedding is cancelled for any reasons as listed below, Couple will forfeit all monies paid to Officiant. Should Couple choose to cancel last minute wedding and forfeit deposit, for any circumstances including rescheduling, cancellations, emergency, casualty, injury, acts of God, nature or terror, or other cause beyond the control of the parties, no liability will be held against Officiant. Couple agrees that no further damages may be sought against Officiant or any persons affiliated with Officiant.
9. Should Couple have any of the above circumstances and need to reschedule or cancel a last minute wedding, Officiant will allow Couple to reschedule services and apply 50% of payment for up to ONE (1) years from selected wedding date. Couple understands that remaining balance will be forfeited and understands that in this time frame many services have already been booked and rendered. Couple must notify Officiant in writing of reschedule within SIXTY (60) day of cancellation with new wedding date. Couple will be charged at rate of booking upon newly scheduled wedding date and may be subject to an increase in pricing.
10. PACKAGE CHANGES: Couples may only use wedding deposits to upgrade packages. Deposits are completely non-refundable. Should couple desire to change to a lesser package resulting in a reduced final contract amount, couples will be charged a $350 downgrade fee for all package downgrades. Couples will be required to sign a new contract and are subject to current pricing.
11. In the unlikely event that any member of Officiant is unable to be part of the wedding for any reasons including emergency, casualty, injury, acts of God, nature or terror or other cause beyond the control of the parties, no liability will be held against Officiant. A qualified substitute will be made available for the wedding or wedding may be rescheduled for another date. In the unlikely event that a replacement cannot be found, Officiant will provide a refund in full for all monies paid, including the deposit, to Couple. Couple agrees that no further damages may be sought against Officiant or any persons affiliated with Officiant.
12. This contract is based on Officiant's current pricing at time of booking. Price is adjusted periodically and future orders shall be charged at prices in effect at the time when the order is placed.
13. Officiant provides support, guidance, ceremony drafts, and wedding planning services as outlined in chosen wedding package to Couple via phone, email, and text during normal business hours HST. This does not include times when Officiant is Out Of The Office. Officiant performs ceremonies islandwide and is often out of cellphone range. The best method to reach Officiant is Email. Officiant does best to return all correspondence within 48 hours.
14. Officiant agrees to perform ceremony in a professional manner in accordance with Final Ceremony Draft delivered to couple before wedding.
15. TEAM officiants are based on availability. Individual officiants cannot be guaranteed due to preference.
16. It is understood that when couple purchases a WEDDING PACKAGE (Officiant + Photography) from Officiant, Officiant is the exclusive photographer retained to perform the wedding. Officiant will choose the best images from the wedding ceremony. Officiant does not guarantee any photographs. Officiant does not show or provide raw images nor involve the client in the process of choosing images for the final edit. Officiant chooses the best images for the final edit. Officiant does not involve client in editing process including but not limited to culling, post-processing, color correcting, retouching, cropping. Officiant does not provide re-edits to photographs. Officiant does not provide "Photoshop" to photographs at request of clients. Final Galleries include 2x as many images as contracted packages so that couples may choose their favorite photographs included with wedding package. Couple may purchase full gallery at discounted rate. Final edited images will be provided to couple within 6-10 weeks of wedding date. **Additional galleries beyond Final Galleries are prepaid at the rate of $3 per image in bundles of 50 photographs.
17. It is understood that when a couple purchases a WEDDING PACKAGE containing photography (Officiant + Photography) from Officiant, Officiant is the exclusive photographer retained to perform the wedding. Officiant does not involve the client in the editing process.
18. It is understood that when couple purchases a WEDDING PACKAGE (Officiant + Photography) all rights to photography and video shall remain property of Kona Wedding Officiant and may be used for advertising, marketing, display or any other purpose deemed fit. All photography is performed by a team of talented Associate Photographers and is assigned based on availability. Requests may be made for specific photographers, but are in no way guaranteed. To ensure quality and consistency of work, all work is edited in house. Kona Wedding Officiant authorizes the owner of this media to print these files. Original copyright remains with Kona Wedding Officiant.
19. Officiant cannot be held responsible for weather, destruction of equipment or loss or images due to acts of God, terror, nature, or lost images due to technical failure, including but not limited to: accident, human error, loss of materials, damage to materials, damaged from processing, camera malfunction, materials lost in the mail, fire, flood, tsunami, hurricane, equipment problems, memory card corruption, or other failures. In the event of these unfortunate and unlikely circumstances, Couple will be fully refunded for photography and/or videography lost. Couple agrees that no further damages may be sought against Officiant or any persons affiliated with Officiant.
20. Travel fees will be based on Officiant's current price at time of booking. Price is adjusted periodically and future orders shall be charged at prices in effect at the time the order is placed.
21. The Kona Wedding Officiant Shop (hereby known as SHOP) entitles Couple to create their own wedding package or purchase add-ons to enhance Simple Weddings and Packages. All items purchased from Shop will be delivered to wedding. If Couple decides to cancel any item purchased in Shop, Couple must do so at least THIRTY (30) days before wedding date. If item is not cancelled with THIRTY (30) days notice, all monies paid to Shop are non-refundable for all circumstances including rescheduling, cancellations, emergency, casualty, injury, acts of God, nature or terror, or other cause beyond the control of the parties. Should Couple choose to cancel Shop item and forfeit goods, no liability will be held against Officiant. Couple agrees that no further damages may be sought against Officiant or any persons affiliated with Officiant.
22. Should Couple have any of the above circumstances and need to reschedule or cancel their wedding and Shop items, Officiant will allow Couple to reschedule goods and apply 100% shop credit for up to ONE (1) years from selected wedding date for all weddings cancelled with at least THIRTY (30) days notice. Couple must notify Officiant in writing of reschedule within SIXTY (60) day of cancellation with new wedding date. Couple will be charged at rate of booking of newly purchased items and may be subject to an increase in pricing.
23. Should a Couple go over planned package time due to tardiness or any circumstances which have made them late to their booked wedding time, Couple will be charged at the rate of: OFFICIANT ONLY WEDDINGS @ $150/hour; ELOPEMENT PACKAGES @ $300/hour; FAMILY WEDDING PACKAGES @ $600/hour; ADVENTURE WEDDINGS @ $600/hour. Time will be charged to the nearest half hour and Couple will be invoiced by Officiant after ceremony. A grace period of 20 minutes will be extended to Couple at the start of the wedding for incidences out of their control and all other reasons causing tardiness.
24. Officiant will do their best to work with Couple to provide a warm, intimate, and loving wedding experience. Officiant believes that Aloha is the most important element of your wedding and will go to great lengths to provide this spirit throughout the wedding process. Officiant will work with Couple to craft ceremony and wedding, and create a compassionate relationship during Couple's planning experience.
25. Officiant will sign and date this Contract after receiving signed and dated copy from Responsible Party below.
26. This contract, once signed either by hand or digitally, is considered legal and binding by all parties in accordance with the law and all conditions set forth herein. All parties shall abide by the agreed upon terms.
27. Officiant is not liable for personal injury, illness, or any other condition, or effect that results directly or indirectly during duration of events.
28. *FLEXIBLE REBOOKING AVAILABLE FOR CORONAVIRUS.*
Should Couple need to reschedule their wedding and/or Shop items 10 days prior to their wedding date due to Coronavirus travel restrictions, Couple may reschedule as needed and apply 100% of monies paid for 545 days from the date of cancellation. Couple must notify Officiant in writing of reschedule within SIXTY (60) days of cancellation date with a new date. Deposits are non-refundable for all circumstances including rescheduling, cancellations, emergency, casualty, injury, acts of God, nature or terror, or other cause beyond the control of the parties. Should Couple choose to cancel Wedding or Shop item and forfeit goods, no liability will be held against Officiant. Couple agrees that no further damages may be sought against Officiant or any persons affiliated with Officiant. Couple will be charged at rate of booking of newly purchased items and may be subject to an increase in annual pricing.
