TERMS AND CONDITIONS OF ETF CLIMBATHON 2018

EVENT TERMS

1. The ETF Climbathon 2018 (the “Event”) is a walking event organised by Yayasan MENDAKI (UEN.: 198902633C) (the “Organiser”) with the support of its sponsors (the “Sponsors”).

2. The Event will be held on 28 January 2018 at the Hort Park located at 33 Hyderabad Road, Singapore 119578 (the “Event Location”).

3. The Event is open to all persons who have registered for and/or participates in the Event except as otherwise excluded by the Organiser in its sole and absolute discretion.

4. Any person who registers, attends and/or participates in the Event (the “Participant”) agrees to be bound to, and abide by, the terms and conditions hereunder (the “Terms”).

PARTICIPANT REGISTRATION

5. All Participants shall register with the Organiser in order to attend and participate in the Event.

6. The Participant agrees and undertakes: (i) at the point of registration, to provide true, accurate, current and complete information about the Participant in such registration form specified by the Organiser for purposes of the Event (the “Registration Data”), (ii) to promptly update the Organiser of any changes to the Registration Data prior to the Event, and (iii) to complete the indemnity form specified by the Organiser for purposes of the Event and be bound by the provisions contained in the indemnity form.

7. In the event that any information in the Registration Data provided by a Participant is found to be untrue, inaccurate or incomplete (or if the Organiser has reasonable grounds to suspect the same), the Organiser shall reserve the right to terminate the Participant's participation in the Event and the Organiser shall not be liable for any reimbursement, compensation and/or payment of any nature (including in relation to any registration fees paid) to such Participant.

8. The Organiser shall not be held responsible for any untrue, inaccurate or incomplete Registration Data provided by any Participant and the Participant agrees to fully indemnify the Organiser against all loss, costs, expense or liability of any nature as may be incurred or suffered by the Organiser for any untrue, inaccurate or incomplete Registration Data provided by the Participant.

9. The Participant agrees that the Organiser may utilise, rely on and/or disclose the Participant’s Registration Data (including contacting the Participant from time to time) for purposes of: (i) verifying the Registration Data, (ii) updating the Participant in relation to the Event, (iii) dealing with any medical or security emergencies relating to the Participant or the Event, (iv) undertaking promotional or event publicity for the Event or any other events conducted by the Organiser and/or its Sponsors, (v) complying with all legal obligations on the part of the Organiser in relation to the Event and/or Event Location and (vi) all other purposes related to or in connection with the foregoing and the Participant hereby expressly consents to such use, reliance and/or disclosure of the Participant’s Registration Data by the Organiser for such purpose unless and otherwise notified by the Participant to the Organiser’s Personal Data Protection Officer in writing at dpo@mendaki.org.sg. Without prejudice to the foregoing, the Organiser reserves the right to terminate the participation of any Participant in the Event upon such Participant’s withdrawal of his/her consent for the use, reliance and/or disclosure of his/her Registration Data as provided hereunder.

10. Participants below 18 years of age are required to seek parental or guardian consent before participating in the Event. The Organiser reserves the right to refuse participation of any Participant below 18 years of age in the absence of such parental or guardian consent.

11. The Organiser reserves the right at any time to alter or limit the number of Participants for the Event without assigning any reasons whatsoever.

12. Each Participant acknowledges, agrees and accepts that photographs, video/film recording, voice/sound recordings and other forms of records will be undertaken at the Event by the Organiser and/or its Sponsors for purposes relating to or in connection with: (i) the organisation, implementation, statistical study/analysis and record of the Event (including for future editions of the Event), (ii) the creation, production, distribution and/or sale of Event related products or paraphernalia, (iii) any advertising, promotional and publicity activities of the Event, the Organiser and/or its Sponsors (including for future editions of the Event), (iv) security and safety management of the Event and the Event Location and (v) complying with all legal obligations on the part of the Organiser in relation to the Event and/or Event Location (collectively, the “Purposes”). The Participant hereby irrevocably consents to the disclosure of all photographs, video/film recording, voice/sound recordings and other forms of records undertaken at the Event by the Organiser that discloses the Participant’s name, image, photos, personal data, likeness and/or participation in the Event for: (i) the Purposes and (ii) in any manner as the Organiser and/or its Sponsors shall deem fit and the Participant hereby irrevocably waives all claims for compensation, remuneration or further approval in respect thereof.

REGISTRATION FEES

13. The Organiser reserves the right to impose such registration and administration fees for the Event as it shall deem fit (including the setting of varying registration fees for different categories of Participants as the Organiser shall in its sole discretion determine).

14. All registration fees paid shall be non-refundable and no request for the refund of registration fees paid will be entertained by the Organiser.

EVENT PACKS

15. The Organiser may issue complimentary Event packs to Participants who have successfully registered for the Event.

16. The issuance and collection of the Event packs shall be at such location(s) and timing as the Organiser shall in its sole discretion determine and which issuance shall be undertaken on a “first come first serve” and “whilst stocks last basis”.

17. The Organiser may at any time, withdraw, suspend or terminate the issuance of the Event packs.

18. The Organiser reserves the right to replace the Event pack items with items of similar value.

19. Notwithstanding the foregoing, the Organiser makes no representation, warranty or guarantee, either express or implied, regarding any items contained in the Event packs including but not limited to the quality or fitness for a particular purpose of any of the items contained in the Event packs.

SAFETY AND ROUTE

20. By participating in the Event, the Participant shall be deemed to have familiarised himself/herself with the Event Location and the planned walking route for the Event (the “Route”) and warrants to the Organiser that the Participant is sufficiently fit and healthy to take part in Event and have, as necessary, sought prior medical advice from his/her medical practitioner certifying the Participant’s fitness to participate in the Event.

21. Notwithstanding the foregoing, the Organiser reserves the right to refuse entry of any Participant to the Event in its sole and absolute discretion (including withdrawing any Participant at any time during the course of the Event), with no refund or reimbursement (including of any registration fees paid), compensation or payment provided to such Participant if the Organiser considers: (i) the Participant to be medically and/or physically unfit to take part in the Event, (ii) the Participant to be physically incapable of continuing or completing the Event, (iii) it necessary to prevent the Participant from causing further harm and injury to himself/herself, or (iv) it necessary for the safety, well-being and/or comfort of the other Participants.

22. For the comfort and safety of all Participants: (i) no pets (except service animals), (ii) any form of wheel-run objects of transport (e.g. inline skates, skateboards, prams, push cars, shoes with built-in or attached rollers) or (iii) personal mobility devices (e.g. electric bicycles, electric scooters, hoover boards, etc.) are allowed or permitted at the Event.

23. The Organiser reserves the right to amend the Route at any time as it shall deem necessary for the comfort and safety of the Participants and the Organiser shall not be liable for any loss or inconvenience caused from such amendments.

24. The Participant shall: (i) strictly observe and adhere to the Route established by the Organiser for the Event and any laws, rules and regulations governing the usage of the Route and/or Event Location, (ii) not trespass into any private property along the Route, and (iii) respect the environment by not interfering with or harming any plants and/or wildlife found along the Route.

25. The Participant shall follow and comply with all Route and safety markers for the Event.

26. The Participant shall complete the Route within the cut-off time as specified by the Organiser for the Event. The Organiser shall not be liable for any death, injury, loss or damage, incurred or suffered by any Participant who does not complete the Route in the specified time or fails to adhere to the Route.

27. The Participant shall: (i) abide with all lawful directions given by the police or emergency services personnel as well as all officials, road wardens, medical personnel, volunteers and all other officials present, appointed or engaged for purposes of ensuring the safety of the Event (collectively, the “Authorised Personnel”) and, (ii) not hurt, harm or use aggressive and/or abusive language against any Authorised Personnel.

28. The Organiser reserves the right to advance, delay or postpone the commencement of the Event in the event of inclement weather. Should the inclement weather persist notwithstanding such advancement, delay or postponement, the Organiser reserves the right to cancel the Event forthwith and the Organiser shall not be liable for any reimbursement, compensation and/or payment of any nature (including in relation to any registration fees paid by the Participant).

29. Notwithstanding any of the Terms hereunder, the Organiser and its Sponsors (including their respective officers, employees and agents) shall not be liable for any death, injury, loss or damage, incurred or suffered by any Participant in the course of, or arising from, the Event including but not limited to such death, injury, loss or damage caused or attributed, directly or indirectly, to a Participant’s breach or non-compliance of the Terms, the Participant’s refusal to comply with lawful instructions and directions given during the course of the Event or the Participant’s wilful behaviour or conduct, negligence, omission or error during the Event.

AMENDMENTS, CANCELLATION & GOVERNING LAW

30. The Organiser reserves the right to amend the Terms at any time without giving prior notification or any reasons thereof.

31. The Organiser reserves the right to cancel or postpone the Event at any time without prior notice to the Participants provided that the Organiser shall use its reasonable efforts to inform the Participants of such cancellation or postponement (including putting such notice on its website). Notwithstanding such cancellation or postponement by the Organiser, there shall be no refund of registration fees paid and the Organiser shall not be liable for any other loss or inconvenience caused arising from such cancellation or postponement.

32. These terms and conditions shall be governed and construed by the laws of Singapore and any dispute arising therefrom (including in relation to the Event) shall be submitted to the exclusive jurisdiction of the Singapore courts.
