LOMITA CHAMBER OF COMMERCE: WELLNESS WALK
WAIVER, RELEASE, HOLD HARMLESS, AND AGREEMENT NOT TO SUE
I acknowledge and fully understand that my participation, or the participation of any minor(s) for whom I am the parent or legal guardian and have the legal capacity to contract, in the Lomita Health Fair Wellness Walk taking place on May 31, 2026, in connection with the Lomita Health Fair (hereinafter “program”) exposes me or the minor(s) for whom I am responsible to the risk of personal injury, death, communicable diseases, illnesses, viruses, or property damage.
I hereby acknowledge that I am voluntarily participating in, or voluntarily allowing any minor for whom I am responsible to participate in, the program and agree to assume all such risks.
I hereby release, discharge, and agree not to sue the Lomita Chamber of Commerce and the City of Lomita, including their respective officials, officers, employees, volunteers, agents, representatives, and affiliated partners (collectively referred to as “Released Parties”), for any injury, death, or damage to or loss of personal property arising out of, or in connection with, my participation, or the participation of any minor(s) for whom I am responsible, in the program, from whatever cause, including the active or passive negligence of the Released Parties or any other participants in the program.
The parties to this Agreement understand that this document is not intended to release any party from any act or omission of “gross negligence,” as that term is used in applicable case law and/or statutory provision.
In consideration for being permitted to participate in the program, I hereby agree to indemnify and hold harmless the Released Parties from any and all claims, demands, actions, or suits arising out of or in connection with my participation, or the participation of any minor(s) for whom I am responsible, in the program.
I HAVE CAREFULLY READ THIS RELEASE AGREEMENT NOT TO SUE AND FULLY UNDERSTAND ITS CONTENTS AS IT APPLIES TO MYSELF AND TO ANY MINORS FOR WHOM I AM RESPONSIBLE. I AM AWARE THAT IT IS A FULL RELEASE OF LIABILITY AND SIGN IT OF MY OWN FREE WILL.
I CERTIFY THAT I AM THE LEGAL CUSTODIAN OF ANY MINOR(S) LISTED BELOW AND THAT I HAVE FULL LEGAL AUTHORITY TO ENTER INTO THIS AGREEMENT ON BEHALF OF THE MINOR(S).
