Please read this Liability Waiver and Release Form carefully before signing. By signing below, you acknowledge that you have read, understood, and agreed to the terms and conditions stated herein.
ASSUMPTION OF RISKS:
I, the undersigned parent/guardian, understand that participating in Heads or Trails events involves inherent risks, including but not limited to those associated with running, biking, or both activities. These risks may include, but are not limited to, falls, collisions, equipment failure, weather conditions, and other unforeseen events. I acknowledge that my child's
participation in the event is voluntary, and I assume all risks associated with it.
PARENTAL/GUARDIAN CONSENT:
I certify that I am the parent or legal guardian of the minor child named above and that I have the legal authority to execute this Liability Waiver and Release Form on behalf of the minor child.
I acknowledge that as the parent or legal guardian of the U-13 minor participating in the 2024 events, it is my responsibility to accompany my child to the event and take full responsibility for the child during the events. I understand that there are only course marshals at some intersections, and that my child will be responsible for knowing the course and navigating the trails on their own for much of the race. I understand that the
courses may present certain difficulties and challenges, and I confirm that I am
fully aware of the course's difficulty level. I also affirm that I have assessed my child's skills and capabilities, and I am confident that they possess the necessary competence and experience to complete the events safely. I will ensure that my child receives appropriate guidance and supervision during the race to mitigate any risks.
RELEASE OF LIABILITY:
In consideration of allowing my child to participate in one or more events, I hereby release, discharge, and hold harmless Heads Or Trails Inc., its officers, directors, employees, volunteers, agents, and sponsors from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by my child while participating in the event, regardless of whether such loss, damage, injury, or death is caused by the negligence of Heads or Trails Inc. or any other party.
MEDICAL TREATMENT:
I authorize Heads or Trails Inc. and its representatives to seek medical treatment for my child in the event of an emergency or injury during the events. I understand that Heads or Trails Inc. will make reasonable efforts to contact me prior to obtaining medical treatment but may do so without delay if they are unable to reach me.
PHOTOGRAPHY AND PUBLICITY:
I hereby grant Heads or Trails Inc. the right to use photographs, video recordings, and other media of my child taken during the events for promotional and publicity purposes without any compensation to me or my child.
ASSUMPTION OF RESPONSIBILITY:
I acknowledge that I am responsible for the supervision of my child during the
event and will ensure that my child abides by all event rules and instructions
provided by Heads or Trails Inc. and its representatives.
CHOICE OF LAW:
This Liability Waiver and Release Form shall be governed by and construed in
accordance with the laws of BC, Canada. Any legal action or proceeding arising
out of or relating to this form shall be brought in the courts of BC, Canada.
