PARISH PROUD WAIVER AND RELEASE OF LIABILITY
As a condition of being allowed to volunteer in activities and events organized and hosted by Louisiana Proud, LLC d/b/a Parish Proud (“Parish Proud”), I, the undersigned individual, for myself and/or my minor child(ren), acknowledge the following:
1. Parish Proud organizes and hosts various litter abatement, blight abatement, streetscape, tree plantings, and other related activities and events designed to eradicate litter, trash and other waste and promote the beautification of Lafayette Parish, Louisiana.
2. GENERAL EVENT INFORMATION:
a. All of the activities and events organized and hosted by Parish Proud involve physical activity, including without limitation walking, painting, lifting, bending, and carrying, as well as social contact with other participants.
b. Many of the activities and events organized and hosted by Parish Proud may be located near roads and highways with varying degrees of automobile traffic.
c. Many of the activities and events organized and hosted by Parish Proud may be located near rivers, bayous, lakes, ponds, and other bodies of water.
d. Many of the activities and events organized and hosted by Parish Proud may expose participants to outdoor flora (plants, trees, etc.) and fauna (animals).
3. RISKS:
a. There is a serious risk of injury or death associated with each of the activities and events organized and hosted by Parish Proud, including cuts, bruises, sprains (to ankles and other joints), strains, soreness, torn muscles, broken and dislocated bones, automobile accidents, and various other injuries and/or death.
b. There is also a risk of encountering discarded illegal substances, drug paraphernalia, weapons, bodily fluids, and human remains.
c. There is a risk of drowning for activities and events involving water.
d. For outdoor activities and events, there is a risk of exposure to: (i) poison ivy, poison oak, poison sumac, hay fever, and/or other poisonous plants and/or allergens (i.e., substances that trigger allergic reactions); and (ii) fleas, ticks, snakes, spiders, mosquitos, wasps, bees, hornets, feral dogs, and/or other poisonous and/or biting insects and animals.
4. Certain medical conditions might prevent the safe participation in the activities and events organized and hosted by Parish Proud, including asthma and other respiratory (breathing) problems, any heart condition, seizures, physical or mental abnormalities, and various other medical conditions.
5. Parish Proud does not monitor minor children participating in its activities and events. Parents and Guardians are responsible for ensuring the safety of their children during any Parish Proud activities and events.
After reading the above paragraphs, I further agree to each of the following provisions:
1.I hereby assume and accept, for myself and my minor child(ren), all of the inherent risks associated with my participation, or the participation of my minor child(ren), in any activities and events organized and hosted by Parish Proud, including without limitation the risk of physical injury, allergic reaction, automobile accident, death, drowning, mental anguish, and each of the other risks listed in the above paragraphs.
2.I hereby waive, release, hold harmless, and agree to indemnify Parish Proud, its officers, directors, members, trustees, insurers, agents, and employees from and against any and all present and future claims, causes of action, and/or damages that I may have, for myself and my minor child(ren), arising from, related to, or in any way associated with my participation, or the participation of my minor child(ren), in any activities or events organized and hosted by Parish Proud, including without limitation any physical injury, allergic reaction, automobile accident, death, drowning, medical treatment, mental anguish, medical costs, attorney fees and court costs, and/or any other liabilities whatsoever.
3.I hereby give full permission for Parish Proud, its officers, directors, members, trustees, insurers, agents and employees to use any and all media I or anyone associated with me appears in at this event. I understand these photos can used for all purposes by Parish Proud.
I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY AND I UNDERSTAND THE ABOVE TERMS AND CONDITIONS. I FURTHER ACKNOWLEDGE THAT I AM GIVING UP CERTAIN RIGHTS THAT I MAY HAVE NOW OR IN THE FUTURE AGAINST PARISH PROUD, INCLUDING THE RIGTH TO FILE SUIT AGAINST PARISH PROUD. I FURTHER ACKNOWLEDGE THAT I AM ASSUMING AND ACCEPTING THE RISK OF INJURY TO MYSELF AND MY CHILD(REN).
