Participant Release and Waiver of Liability Agreement
This Release and Waiver of Liability Agreement (the/this “Release”) executed on the date submitted below by the undersigned, including without limitation their guests, family members, heirs, dependents, executors, administrators, successors and assigns (collectively the “Participant”) releases the Siege of Lake Superior Tournament and its owners, directors, coaches, volunteers, referees, EMTs, employees, host arenas, agents, affiliates, successors, assigns, corporate partners, donors, sponsors, supporters, insurers and other representatives, including Kaitlyn Ruedebusch (collectively the “SLS Tournament”) from any and all claims, liabilities or damages for injuries, losses or harm incurred as a result of participation in the events and activities put on by the SLS Tournament. In consideration for being allowed to participate in the SLS Tournament’s events and voluntarily agrees to the following:
1. Waiver and Release: I (the Participant) release and forever discharge and hold harmless the SLS Tournament from any and all liability, claims, demands and damages of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from my participation in the SLS Tournament’s events. I understand and acknowledge that this Release discharges the SLS Tournament from any liability or claim that I, or any other person or entity on my behalf may have against the SLS Tournament with respect to bodily injury, personal injury, illness, death, loss or property damage that may result from my participation in the SLS Tournament’s events.
2. Assumption of Risk: I understand that participation in the SLS Tournament’s events includes activities that may be hazardous to me, including but not limited to ice hockey, ice hockey activities, physical contact and other competitive sports activities. I understand that ice hockey is an inherently dangerous activity. As a participant, I hereby expressly assume risk of injury or harm from these activities and release the SLS Tournament from any and all liability for the same.
3. Insurance: I understand that the SLS Tournament does not assume any responsibility for or obligation to provide me with financial or other assistance, including but not limited to medical, health, liability or disability insurance. I expressly waive any claim to such insurance coverage. I also understand that the SLS Tournament’s events are not covered and/or sanctioned by any formal entity or organization and thus medical and/or personal injury claims are not covered under any other entity, corporation or organization insurance policy. Finally, I understand that I am responsible for obtaining and paying for any insurance coverage I deem appropriate and warranted given the activities that I undertake.
4. Medical Treatment: I hereby release and forever discharge the SLS Tournament from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during my participation in the SLS Tournament’s events. I agree to be personally responsible for any related medical expense and understand that any injury will be treated in accordance to the procedures set in place by the tournament EMTs and medical staff.
5. Photographic Release: I grant and convey to the SLS Tournament all right, title, and interests in any and all photographs, images, video, or audio recordings of me or my likeness or voice made by the SLS Tournament in connection with my participation at the SLS Tournament’s events. I waive any right to inspect or approve the finished product and acknowledge that I am not entitled to any compensation for creation or use of the finished product.
6. Other: I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Minnesota and State of Wisconsin and that this Release shall be governed by and interpreted in accordance with the laws of the State of Minnesota and State of Wisconsin. This Release is made on behalf of myself as well as my heirs, executors and administrators with the intent that the SLS Tournament will be held harmless from any potential claim, demand or liability arising from my participation at the SLS Tournament’s events. I agree that in the event that any clause or provision of this Release is deemed invalid, the enforceability of the remaining provisions of this Release shall not be affected.
FORM SUBMISSION SHALL BE CONSIDERED YOUR ELECTRONIC SIGNATURE AND SHALL BE DEEMED VALID AND BINDING FOR PURPOSES OF THIS RELEASE.
