Please read the following agreement carefully before proceeding with your registration. By checking the box at the end of this statement, you are acknowledging that you understand and agree to its terms.

This Waiver and Release of Liability (this "Release") is entered into by and between Friends of Fonde Park (the "Organization"), located at Houston, TX 77023, and the Participant registering for this event (the "Participant"). If the Participant is under 18 years of age, this agreement is also acknowledged by their Parent/Legal Guardian.

Activity Description: This Release applies to participation in the Fonde Fit & RLDC 5K/1K Walk-Run. The Activity will take place on August 30, 2025 at Fonde Park, Houston, TX 77023.

Assumption of Risk: I, the Participant (and Parent/Legal Guardian, if applicable), understand and acknowledge that participation in the Activity involves inherent risks, dangers, and hazards that may cause injury, death, or property damage. These risks include, but are not limited to: physical exertion, falls, slips, or trips; exposure to weather conditions (e.g., heat, sun, rain, humidity); dehydration or heat-related illness; contact with other participants, spectators, or vehicles; uneven terrain, obstacles, or debris on the course; injuries sustained from overexertion, muscle strains, or sprains; hazards present in an outdoor or public environment; and interaction with other participants or the public.

I voluntarily accept and assume all risks of injury, death, or property damage, whether known or unknown, that may arise from my (or my child's) participation in the Activity.

Release and Waiver of Liability: In consideration of being permitted to participate in the Activity, I, the Participant (and Parent/Legal Guardian, if applicable), for myself and my heirs, executors, administrators, personal representatives, and assigns, HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the Organization, its officers, directors, employees, volunteers, agents, sponsors, and representatives (collectively, the "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by me (or my child), or any property belonging to me (or my child), whether caused by the negligence of the Released Parties or otherwise, while participating in the Activity, or while in, on, or upon the premises where the Activity is being conducted.

Indemnification: I, the Participant (and Parent/Legal Guardian, if applicable), agree to INDEMNIFY AND HOLD HARMLESS the Released Parties from any and all losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) incurred by the Released Parties as a result of any claims, demands, or actions brought by me (or my child), or by anyone acting on my (or my child's) behalf, or by any third party, arising from my (or my child's) participation in the Activity.

Medical Treatment Consent (if applicable): In the event of an injury or illness during the Activity, I authorize the Organization and its representatives to seek and consent to medical attention, including emergency medical treatment, for me (or my child) on my (or my child's) behalf. I agree to be responsible for any medical expenses incurred.

Severability: If any provision of this Release is found to be unenforceable or invalid, that provision shall be severed from this Release, and the remainder of this Release shall remain in full force and effect.

Governing Law: This Release shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles.

I, the Participant (and Parent/Legal Guardian, if applicable), HAVE CAREFULLY READ THIS WAIVER AND RELEASE OF LIABILITY AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT BY PROCEEDING WITH THIS REGISTRATION, I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE ORGANIZATION AND THE RELEASED PARTIES.

For Participants Under 18 Years of Age:

By checking the box below, the undersigned Parent/Legal Guardian acknowledges they are the legal guardian of the Participant, and hereby consent to the Participant's involvement in the Activity. The Parent/Legal Guardian has read and understands this Release, and agrees to its terms on behalf of the Participant and themselves. The Parent/Legal Guardian further agrees to indemnify and hold harmless the Released Parties from any claims brought by or on behalf of the Participant relating to the Activity.
