These Driver-Referral-Driver Terms and Conditions (“DRD T&C”) govern the participation in the Lalamove Driver-Referral-Driver Program (“Program”).

Defined terms shall have the meaning set out in the Delivery Partner Terms of Use, unless otherwise defined herein.

A. Program participation 

1. Scope of Program. The Program allows registered Delivery Partners with the Delivery Partner Account status “normal” as specified in the application for Delivery Partner (i.e. an active Delivery Partner Account) (“Referrers”, each a “Referrer”) to earn rewards by referring new Delivery Partners (“Referees”, each a “Referee”) to the Platform. The Program is not applicable to referrals of Account Sharing Partners and Subcontractors.

2. Participation. To participate in the Program, a Referrer shall provide a Referee with a valid referral code, and the Referee shall register for a Delivery Partner Account for the first time using the Referrer’s referral code. The following scenarios are, for example, not considered first registrations on the Platform:

previous participation in the Program as a Referee, regardless of whether he/she has successfully completed the Mission (as defined in clause ‎B.‎1) and received rewards;

deletion of a Delivery Partner Account and re-registration with a new Delivery Partner Account; and

registration as Delivery Partner with a new vehicle after already having a Delivery Partner Account for another vehicle.

3. Referral code after registration. A referral code cannot be linked to a Delivery Partner Account after registration has started by entering a mobile number.

B. Rewards

1. Requirements for rewards. In order for the Referee and the Referrer to each receive a reward,

the Referee’s application for a Delivery Partner Account needs to be approved by Lalamove;

the Referee needs to complete certain requirements, such as providing a specific number of Shipment Deliveries within a specified time (“Mission”), as further set out on the “Referrer Page” in the application for Delivery Partner and the Driver Refer Driver Landing Page;

the Referee must not cancel Shipment Deliveries without an objectively legitimate reason during the Mission period; and

the status of the Referee’s and the Referrer’s Delivery Partner Accounts must be and remain throughout the entire Mission period “normal” (i.e. active).

2. Fraudulent activity, misuse of the Program or violation of the DRD T&C. A referral shall be deemed ineligible for the Program, and a Shipment Delivery shall not be counted towards the Mission, if Lalamove determines, based on objective indications, that the referral or the Shipment Delivery  is fraudulent, constitutes misuse of the Program, or violates these DRD T&C. Examples for misuse of the Program are the creation of multiple or fake Delivery Partner Accounts or self-referrals. Lalamove reserves the right to revoke released rewards from the Referrer and/or the Referee (and the Referrer and/or the Referee shall return any such revoked rewards) if it suspects, based on objective indications, that the reward was earned through fraudulent activity, misuse of the Program or violation of these DRD T&C.

3. Payment of rewards. If the requirements in clause ‎B.‎1 are fulfilled and subject to clause ‎B.‎2, rewards will be credited to the Delivery Partner wallet balance of the Referee and the Referrer within fourteen (14) working days of the Referee completing the Mission.

C. General

1. Own device / Delivery Partner Account. The Delivery Partners shall only use their own device and Delivery Partner Account to operate any activities of their own registered Delivery Partner Account.

2. Processing of personal data. The processing of personal data under this Program is subject to the Lalamove Privacy Notice. The Delivery Partner shall have read and understood the Privacy Notice before participating in the Program.

3. Restriction, suspension and termination of the Services. Any violations of these DRD T&C by the Delivery Partner (regardless of whether as Referee or as Referrer) may result in temporary or permanent restrictions, suspensions or termination of the Services. More detailed information can be found in the Delivery Partner Terms of Use.

4. Discontinuation of the Program. Lalamove reserves the right to discontinue this Program at its sole discretion by providing no less than fifteen (15) days’ prior written (including text message) notice to the Delivery Partners. Notwithstanding the discontinuation,

any Mission that a Referee has validly commenced before the effective date of the discontinuation will remain unaffected, and the Referee shall be entitled to complete such Mission within the remainder of the completion period originally applicable to such Mission (as defined and specified on the “Referrer Page” in the application for Delivery Partner and the Driver Refer Driver Landing Page); and

any Referee who has applied for registration of a Delivery Partner Account using a then-valid referral code before the effective date of the discontinuation shall, if and after registration has been accepted by Lalamove, be permitted to complete the Mission within the completion period applicable to such Mission (as defined and specified on the “Referrer Page” in the application for Delivery Partner and the Driver Refer Driver Landing Page).

In both cases, the Referee and the Referrer shall receive any corresponding rewards in accordance with these Driver Refer Driver T&C.
