In consideration of DAST 2 LLC’s
acceptance of this release form, I(we) the undersigned parent(s) or legal
guardian(s) of all above listed Minor/Player (“Ballplayer(s)”) for
myself/ourselves and our legal representatives and assigns, do hereby agree to
the following:
1. I(We) acknowledge that participation in
athletic activities hosted within the DAST 2 LLC facility located at 5132 E 65th
Street (the Facility) is a potentially injurious activity and that Ballplayer(s)
should not participate unless he/she is medically and physically able to do so;
and I(we) further agree and warrant that Ballplayer(s) is(are) both medically
and physically able to fully participate in the Facility. For and on behalf of
ourselves and Ballplayer(s), I(we) knowingly and freely assume all risks,
injuries, loss, hazards, and dangers, known or unknown, directly or indirectly
relating to Ballplayer(s)’ participation (with "participation"
defined throughout to include without limitation participation in or attendance
at any activity related to the Facility, whether directly involving
Ballplayer(s) or not), including but not limited to any and all risks, loss,
injuries, hazards, and dangers arising from the acts or omissions (including negligence)
of Dast 2 LLC, and/or its directors, officers, agents, employees, coaches,
volunteers, sponsors, other participants or family members or friends of other
participants (collectively, the “Releasees”).
2. In addition, I(we) covenant not to sue
and hereby WAIVE, RELEASE, DISCHARGE, and HOLD HARMLESS the Releasees from any
and all claims, liabilities, demands, damages, and causes of action, present or
future, whether foreseen or unforeseen, for any personal injury, property
damage, or other injury, damage, harm, accident, or loss which may arise from
Ballplayer(s)’ participation in, or which is related in any way to, DAST 2 LLC.
3. I(We) agree that if I(we) observe any
risk or hazard during Ballplayer(s)’ participation, I(we) will bring such to
the attention of the nearest coach or volunteer as soon as possible, so that
they can report it to DAST 2 LLC.
4. I(We) agree that this release, waiver
of liability, and covenant not to sue is intended to be as broad and inclusive
as permitted by law. Should any portion hereof be held invalid, I(we) agree
that the balance hereof shall continue in full legal force and effect. I(We)
further agree to indemnify the Releasees for any costs, fees, or damages
incurred by Releasees as a result of any injury, damage, harm, loss, or
accident in any way related to Ballplayer(s).
5. I(We) grant permission for emergency
first aid to be given to Ballplayer(s) in case of injury but understand that
DAST 2 LLC has no obligation to provide emergency first aid.
6. I(We) understand that DAST 2 LLC does
not provide medical insurance coverage for Ballplayer(s) participants or other
parties.
