Terms & Conditions

Please read these terms and conditions carefully before completing your booking. By completing a booking with us you will have entered into a binding contract on the basis of these terms and conditions. If you have any questions about them please do not hesitate to contact us.

Definitions
“We”, "us", "our" or "ours" means Emily Fawcett and/or Charlie Loram of 2 Buckland Hall, Buckland-in-the-Moor, Ashburton, Devon TQ13 7HL.
The “client” refers to the person named on the “Booking Form”. The “course” refers to "Wild Practice".

2. Agreement: arises upon the fulfilment of the following:
   a) Receipt by us of a completed booking notification accompanied by a deposit.
   b) Clearance of the payment or deposit into Emily Fawcett and Charlie Loram's bank account (or other specified account).
   c) Acceptance by us via an online booking confirmation or via an email confirmation.
   d) We reserve the right, in our absolute discretion and without the need to give reasons, to refuse to accept a booking. In such circumstances no agreement arises and we will return any payment accompanying the booking.
   e) The agreement is between us and the client and is the sole agreement between those parties. No variation of these terms and conditions shall be applicable unless agreed in writing by us before the start of the course.
   f) The person completing the booking shall be deemed to be agreeing to these terms for him/herself and as agent for all other persons listed on the booking and warrants that he/she is appointed agent for that purpose.
   g) The agreement is governed by English law.

3. Payment
Payment will be required in order to secure a place on the course. We reserve the right to cancel the agreement in the event that the course fees are not paid by the agreed time, pursuant to clause 5, below.

4. Prices
Whilst every effort is made to limit prices to those given in the booking form, we reserve the right to alter prices should our costs in hosting the course increase for reasons beyond our reasonable control (including, without limitation, the cost of labour, transport and materials).
   a) In the event that a price is altered the client will be notified as soon as reasonably possible and the balance of the altered price will be payable on the same terms as the original price.
   b) In the event of the price being increased by 15% or more the client may opt to cancel the booking and will be then entitled to a refund of all monies then paid.

5. Cancellation by client
Cancellation of the full advance payment is non-refundable. The Old Way highly recommends the client takes out personal insurance to cover losses in the event they need to cancel.
Cancellation of the monthly subscription requires 6 weeks' notice.  Rejoining the club at a later date having cancelled is subject to a space becoming available. In order to retain a place in the group the monthly fee is payable every month regardless of attendance.

6. Cancellation/alteration of course by us
We are at the mercy of natural variables, including the weather. Whilst every reasonable effort is made to deal with such contingencies there may be occasions when we, through no fault of our own, are forced to cancel a session before it starts but at short notice. In these circumstances the client will be offered the return of monies paid or an alternative date arranged.
Signing these "Terms and Conditions" implies that the client(s) accepts and understands that there are hazards involved in this kind of course, including injury, disease, loss or damage to property, inconvenience and discomfort. The outline itineraries given for each session must therefore be taken as an indication of what each group should accomplish, and not as a contractual obligation on our part.
It is a fundamental condition of joining our course that the client(s) accept this flexibility, and acknowledge that delays and alterations and their results, such as inconvenience, discomfort, or disappointment, are possible: we will always endeavour to provide suitable alternative arrangements.
The client(s) acknowledges that information about our courses is given in the best of faith but that because of the variability of nature it may be reasonable to alter or modify a course and that in such circumstances it is not reasonable for us to be liable for any losses consequential on such a change and that our liability is limited accordingly.
Our courses are in part social events and benefit from the presence of a critical number of persons. If we, in our absolute discretion and without need to give reasons, determine that a critical number will not be present we reserve the right to cancel the course at short notice. In these circumstances the client will be offered the return of monies paid or the opportunity to join the course in a subsequent year.
The client acknowledges that all the circumstances in which we may be forced to alter or cancel the course resulted from factors beyond our control. In return for us undertaking to give the maximum amount of notice that circumstances allow, the client accepts that we are not liable for any losses arising as a result of cancellation or alteration.

7. Expectations and physical ability
The client must expect to be involved in adventurous and sometimes strenuous activities. No previous experience is required but the client must be of good general health. Any medical conditions must be declared on the booking form which must be completed and returned to us on confirmation of booking. We can take no responsibility in the event of any ailment or aggravation of ailment suffered either during or after the programme that arises from an undeclared injury or illness.

8. Code of Conduct:
The client agrees to submit to our reasonable instructions and leadership. The client acknowledges that persons attending our courses are entitled to expect a high standard of conduct and regard for personal well being on the part of all participants.
For this reason the client accepts that we may, in our absolute discretion and without the need to give reasons, arrange for anyone to be removed from a course, if necessary against his/her will. Circumstances in which this might occur include (without limitation) disorderly or abusive conduct; intoxication; incapacity or inability to meet the rigours of the course. In such circumstances the client will not be entitled to a refund of monies and we will not be liable for any losses so resulting. The client will on demand reimburse to us our reasonable costs of effecting his/her removal.

10. Liability
The client(s) acknowledges that by joining the course, our responsibility does not commence until the appointed meeting time, we shall not be responsible for any additional expenses incurred by the client to meet up with the group if the client(s) does not arrive at the appointed rendezvous.
Our courses take place in open countryside and wilderness areas and by their very nature are not absolutely free from hazard. We make every effort to minimise risk to clients, and instruct clients in the safe negotiation of such risk as may remain. Consequently, the client(s) acknowledges that there are circumstances in which an accident could befall a client without our being at fault and accepts that to that extent he/she is taking part in a the course at his/her own risk.
We only accept liability for physical injury to a client(s) that is shown to result from negligence on our part.
The client(s) acknowledges that other loss, damage and expense (including, without limitation, loss of money, loss or damage to clothes and possessions, losses arising on the cancellation of a booking and the expenses of delay and harm caused other than by our negligence) howsoever arising is not our responsibility and that our liability is hereby limited.

11. Insurance
We are covered to a level of £5,000,000 Public Liability Insurance.

12. Complaints
In the unlikely event that a client(s) has cause for complaint about the course, complaint should be made to one of the leaders, in order that corrective action can, if necessary, be taken. Should a problem not be resolved, a complaint should be made in writing within 28 days. To the extent permitted by law we will not be liable in respect of claims first intimated later than 28 days from the close of the relevant course.

13. Changes to this agreement
When making a booking to join the course the client(s) confirms that they have read and understood all the terms and conditions above and agrees to abide by them. We reserve the right to update the Terms & Conditions at any time, without notice.
