2. In further consideration of my participation in one or more fitness classes offered by the instructor, Alexis Payne Lewis, (collectively, “Urban Zumba”) and/or the location: I, do for myself, my heirs, dependents, beneficiaries, executors, and administrators, hereby expressly release, discharge and hold harmless without regard to any negligence or fault of the Released Parties, from any and all responsibility, losses, liabilities, penalties, fines, costs, damages, legal fees and expenses arising from injuries I may sustain or incur as a result of my participation in any physical activity. This further applies to all classes led by Alexis Payne Lewis at any location. IT IS THE INTENTION OF PARTICIPANT BY TYPING HIS/HER NAME BELOW TO EXPRESSLY ASSUME ALL RISK OF PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE UPON HIM/HERSELF, TO THE EXCLUSION OF ALEXIS PAYNE LEWIS, URBAN ZUMBA, AND/OR THE VENUE AND TO EXEMPT AND RELIEVE THE RELEASED PARTIES FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH. The participant further agrees that the participant, his/her spouse, assignees, heirs, guardians, and legal representatives will not make any claim against, sue the released parties for any loss or damage resulting from participant’s participation in the activities.
3.THE PARTICIPANT IS AWARE OF THE POTENTIAL DANGERS INCIDENTAL TO ENGAGING IN THE ACTIVITIES, THAT THIS IS A RELEASE OF LIABILITY, A WAIVER OF THE PARTICIPANT’S LEGAL RIGHT TO COLLECT DAMAGES IN THE EVENT OF INJURY, DEATH OR PROPERTY DAMAGE AND A CONTRACT BETWEEN PARTICIPANT AND ALEXIS PAYNE LEWIS. THE PARTICIPANT SIGNS IT OF HIS/HER OWN FREE WILL.
4. I have consulted with my physician regarding any questions or concerns regarding my ability to participate in these activities. I understand and acknowledge that without my agreement to this Release, I am not authorized or permitted to participate in any fitness classes offered by Alexis Payne Lewis. I am 18 years of age or older, and I have carefully read this Release and know the contents thereof. I sign this Release as my own free act. If under the age of 18, a parent/guardian must sign a waiver.
5. By registering for classes or events, I acknowledge and grant Alexis Payne Lewis permission to use my likeness in photographs and/or videos for promotional and marketing purposes. This includes, but is not limited to, publications, advertisements, social media, website content, and any other promotional materials, without any payment or consideration provided. I acknowledge that these photographs and/or videos become the exclusive property of Alexis Payne Lewis and will not be returned. The attendee authorizes Alexis Payne Lewis to use, edit, copy, publish, or exhibit any photo or video for any lawful purpose related to the promotion of the studio. I also waive the right to review or approve any photo or video before it is used and releases Alexis Payne Lewis from any claims or demands arising out of the use of their likeness, including but not limited to any claims for royalties or compensation. Please note that photographs and videos may be taken during classes and events, and some of them may be shared on Alex website, social media platforms, or other promotional materials. If you do not wish to have your picture or video made public, kindly inform instructor, Alex.
6. I have read the above release waiver of liability and assumption of risk. I fully understand its contents and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily and intend by my signature to be on the complete and unconditional release of all liability. I voluntarily agree to the terms and conditions stated above. This agreement remains in effect for as long as I participate in any classes led by Alexis Payne Lewis leading as instructor.
