Topic: Federal Overtime Exemption Update
Employment law has long been one of the fastest changing areas of law. One of the reasons for the fast pace is that in addition to legislatures and courts, multiple executive agencies have rule making and interpretation authority. For years, the US Department of Labor has been working to update certain overtime exemption rules under the Fair Labor Standards Act that have been in place for decades. Originally, during the Obama administration, the Department of Labor sought multiple changes including raising the minimum salary for the most common overtime exemptions to $47,476 per year. Those restrictions were rejected by the federal courts, and the Trump administration declined to defend them.

Now, the Department of Labor has promulgated more modest updates including raising the salary threshold to $35,568 per year. Keeping up with such developments is crucial for any human resource professional. This presentation will provide a general review of overtime exemptions and an update of the recent changes. In addition, we will examine how employers can plan for and respond to the changes.

Presenter: James Godwin
James is a business litigator at the Godwin Dold law firm in Rochester who devotes much of his practice in labor and employment law. James counsels employers regarding legal compliance issues including wage and hour obligations and discrimination avoidance. He defends employers against employment law claims before the enforcement agencies and in court. James also prepares employment manuals, employment and non-compete agreements, and other employment practices.
James received his B.A. with honors and distinction from the University of Kansas in 2002 and his J.D. from the UCLA School of Law in 2005. James is licensed to practice in Minnesota, California, and Pennsylvania. James has been named a Super Lawyers Rising Star in 2013, 2014, 2015, 2016, 2017, 2018, and 2019.
