This is a release of your legal rights. Review this document carefully and make sure you understand it before signing. Please keep a copy for your records.

I desire to participate in MiddCORE's outdoor activities if I decide to opt into these activities while at Asilomar and in CA. I understand, fully appreciate, and am willing to accept the dangers, hazards and risks inherent in the Activity, including traveling to and from the Activity, and in any independent research or activities I undertake as part of the Activities, which dangers include, but are not limited to, the possibility of injury or illness, including serious injury, paralysis or death, as well as property damage. I understand that supplemental information about dangers, hazards and risks specific to these activities will be provided to me prior to the activities.

I understand that I am not required to participate in these activities but if I do so, I acknowledge that I want to do so, despite the known dangers, hazards and risks. I hereby agree to abide by all rules and instructions governing this Activity. I hereby affirm that I have no health-related conditions that preclude or restrict my participation in this Activity and I agree that, if any such conditions develop prior to the start of the Activity, I will inform Middlebury about them prior to my being allowed to participate in the Activity. I also affirm that I have adequate health insurance to provide for and pay for any medical costs incurred as a result of my participation in this Activity. I am not relying on Middlebury to supervise or control my participation in this Activity, or to warn me of every possible danger associated with it. I understand I am solely responsible for assessing my own skills and abilities to participate safely in this Activity. Knowing the dangers, hazards and risks and in consideration for being allowed to participate, on behalf of myself, my family, estate, heirs, executors, administrators and assigns, I hereby accept all dangers, hazards and risks that may result from my participation in the Activity and I hereby release Middlebury, its employees and agents from any and all claims, suits and expenses for loss of or damage to my property and for any illness or injury to me, including my death, that may result from or occur during my participation in the Activity, whether caused by the negligence of Middlebury, its employees or agents, or otherwise, to the fullest extent allowed by law.

I further agree to indemnify and hold harmless Middlebury, its employees and agents, from all liability, claims, suits, and expenses that may arise out of my own negligent or intentional acts or omissions, while participating in the Trip, and I assume full responsibility for my own actions.

I acknowledge that I a willing participant in one or more of the activities/events during MiddCORE, and that my participation is not required or compelled in any way by Middlebury College. I understand that participation in the activities carries with it certain inherent risks that may not be eliminated even when care is taken to a void injury. The specific risks vary from one activity to another, but the risks range from minor injuries such as scrapes, scratches, bruises and sprains, to major injuries such as eye injuries or loss of sight, joint or back injuries, heart attacks and concussions to catastrophic injuries including paralysis and/or death.

I have read the previous paragraph and I know, understand, and appreciate these and other risks that are inherent in these activities and programs. I hereby assert that my participation is voluntary and that I knowingly assume all such risks.

Release, Indemnification and Hold Harmless:
I also agree, for myself, my heirs and my personal representative(s) to RELEASE and to INDEMNIFY and HOLD Middlebury College and its trustees, agents and employees, including volunteers and student leaders of such activities, HARMLESS from any and all claims, actions, suits, costs, expenses, damages and liabilities of any sort on account of damage to personal property, or personal injury, or death which may result from my participation.

Severability:
I also expressly agree that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by the law of the State of Vermont and Nevada, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

Acknowledgement of Understanding:
I have read this release of liability and assumption of risk and indemnity agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend the agreement by my typing my name below, to be a complete and unconditional release of all liability to the greatest extent allowed by law.

for Middlebury College's MiddCORE Program at Sierra Nevada College

I grant Middlebury College the unrestricted right to use and publish photographs taken of me while participating in MiddCORE. This includes photographs or video in which I may appear, for editorial, social media, promotion purposes, or any other official college purpose whatsoever. This may include print, electronic, or any other media form, and to copyright the same. I hereby release Middlebury College and the college’s legal representative and assigns from any and all claims and liability to said photographs, video, and text.

In order to be certain that students will be assisted in meeting the unexpected and sometimes heavy expensive of an illness or accident, Middlebury College requires its students to have personal health insurance. It is required that if students do not already have health insurance that will provide coverage during MiddCORE, they must obtain coverage prior to arrival. International students in particular should ascertain that their health insurance is valid in the U.S. Before arrival to MiddCORE.
