Summit County Colorado Property Owners Legal Action Funding

Recent actions by the Summit County Board of County Commissioners (BOCC) significantly limiting short-term rentals (STRs) have compelled the creation of a legal defense fund for all property owners within unincorporated Summit County. Summit County Resort Homes Inc. (SCRH), a 501(c)(4) nonprofit, is representing our interests. SCRH is in the process of defending our rights as homeowners by challenging the BOCC’s STR ordinances in U.S. Federal Court. Members of SCRH include those who have concerns about decreasing home values due to the BOCC's STR ordinances, those who would like to rent short-term in the future, and those who are already renting short-term. Subject to advice of our legal counsel, our initial strategy includes the following litigation goals:
  • Filing a broad Colorado Open Records Act request for all background documents and analysis concerning the STR regulations and the defining of “Resort Overlay Zones” versus “Neighborhood Overlay Zones” to allow us to best formulate areas for challenge. (completed)
  • Compile and submit a legal complaint in U.S. Federal Court which applies to ALL unincorporated Summit County properties in order to stop and invalidate the STR regulations approved by the BOCC, including the limitations on the number of STR licenses and bookings. See complaint here. (completed)
  • Pursue the "Resort" STR designation for all unincorporated Summit County properties.
  • Bringing takings claims to seek compensation from the County for individual homeowners who risk being forced to sell their properties if the STR regulations are upheld and they lose rental income.

We need to your help to see this legal process through to fruition. SIGNIFICANT progress has already been made, but there is a long way to go. This declaration form is being used to track progress towards our funding goal needed to complete this legal action. All pledge contributors will be added to a Google Group email server where detailed information will be shared.

Summit County Resort Homes Inc is a 501(c)(4) nonprofit. Contributions or gifts to Summit County Resort Homes Inc are not tax deductible as charitable contributions. However, they may be tax deductible as ordinary and necessary business expenses. Please consult your tax advisor. All organizing, fundraising, and administrative work done at SCRH is performed on an unpaid volunteer basis. Roughly 99% of funds raised through the nonprofit are used to pay our legal team's fees at Brownstein Hyatt Farber Schreck, LLP in prosecuting the lawsuit against Summit County to invalidate the STR regulations. The remaining one percent is used for our website and administrative tools.
