Access to Justice - Transcripts
Dear Birch Mountain Resources Shareholders:

On December 5, 2016 we received the Appeal Court judgment for our appeal hearing held on June 15, 2016

Following the decision we requested transcripts of the June 15th hearing and were subsequently denied by the court stating "... transcripts will not be provided except in exceptional circumstances upon authorization of the panel or judge presiding at the hearing."

This is an unusual turn of events. Transcripts are not usually contested.

We know from shareholders who attended the hearing that one of the judges remarked something to the effect of "something smells here."

And, yet, the decision by the Appeal Court found nothing of merit despite over 300 pieces of evidence contradicting some of their conclusions.

A travesty of justice has taken place and we need the transcripts to prove the errors and omissions of the courts decisions.

Please fill out the petition below so that we may submit it to the court in a further effort to motivate the court to release the transcripts.

Access to Justice - You have a right to know information that impacts your life.

In the interest of access to justice, I am requesting that the Appeal Court of Alberta Canada release the transcripts for the Court of Appeal File Number 1501-0131AC, McDonald v. Brookfield et al.
