Preamble

The Hong Kong Marine Department (MD) has established a Working Group (WG) on 21 February 2024 comprising a wide spectrum of stakeholders in the shipping industry to conduct a comprehensive review of the Merchant Shipping (Registration) Ordinance (Cap.415).

This questionnaire serves to collect initial views and areas of concern arising from WG members’ individual area of expertise in the knowledge and experience on ship registration business for the review of Cap.415. WG members are also welcomed to circulate this questionnaire through their working contact for the sake of obtaining more constructive views for the betterment of the development of Hong Kong Shipping Registry (HKSR).

The information collected will be considered appropriately to formulate the first set of draft paper for upcoming WG meeting in March 2024. Given the tight schedule, your returns on or before 15 March 2024 are highly appreciated.

香港海事處（海事處）於2024年2月21日成立了一個由航運界廣泛範圍持份者成員組成的工作小組，就《商船（註冊）條例》（第415章）進行全面審查。

本問卷旨在按工作小組成員在各自專業領域對船舶註冊事宜的知識和經驗，收集就全面審查第415章的初步意見和關注點。我們亦歡迎工作小組成員透過自己的工作接觸傳閱此問卷以獲取更多建設性意見，更好地促進香港船舶註冊的發展。

For Owner Registration, the majority interest in the ship shall be owned by one or more qualified persons
Under Cap.415 S.11(4) Qualified Person
(a) an individual who holds a valid identity card and who is ordinarily resident in Hong Kong;
(b) a body corporate incorporated in Hong Kong; or
(c) a registered non-Hong Kong company as defined by section 2(1) of the Companies Ordinance (Cap. 622).]

Part F - Any comments / suggestions on the current Qualified Person (QP) requirements for demise charter (DC) registration

[Note:
Under Cap.415 S.11(1)
For DC Registration, the demise charterer (operator) shall be a QP, but the owner of ship does not required to be a QP.
Under Cap.415 S.11(4) Qualified Person
(a) an individual who holds a valid identity card and who is ordinarily resident in Hong Kong;
(b) a body corporate incorporated in Hong Kong; or
(c) a registered non-Hong Kong company as defined by section 2(1) of the Companies Ordinance (Cap. 622).]

Under Cap.415 S.71 Duties, etc. of representative person
(1) The representative person appointed in relation to a ship shall represent the owner and demise charterer of a ship in respect of all matters concerning the ship’s operation as a registered ship and in particular, but without limiting the generality of the foregoing, shall, on behalf of the owner and demise charterer -
(a) accept service of all documents in respect of legal proceedings against the owner or demise charterer of the ship, which may be served on the representative person pursuant to section 88(2);
(b) where the Director or the Registrar by notice served on the owner, demise charterer or representative person requires the owner or demise charterer to take any action or give any information concerning the ship or the operation of the ship as a registered ship, take such action or give such information within the time specified in the notice or, if no such time is specified, within a reasonable time.]

根據Cap.415 S71.代表人的責任等
(1) 就船舶而委任的代表人，在一切關於該船舶作為註冊船舶經營的事宜中，須代表該船舶的船東及轉管租約承租人，但在不限制前述事項的一般性的原則下，尤其須代表該船東及轉管租約承租人作以下事 —
(a) 接受任何人向該船舶的船東或轉管租約承租人提起法律訴訟而依據第88(2)條可送達代表人的所有文件;
(b) 凡處長或註冊官向該船東、轉管租約承租人或代表人送達通知書，規定該船東或轉管租約承租人就該船舶採取行動或提供資料，或就該船舶作為註冊船舶經營事而採取行動或提供資料，則須在該通知書指明的時間內，或如無指明時間，則在一段合理時間內，按規定採取行動或提供資料。]
