A “public charge” determination is used by immigration officials to decide whether a person seeking entry into the U.S. or lawful permanent resident status, is likely to need government assistance to meet basic needs such as health care, access to food, and housing. The Trump Administration has proposed a radical expansion of the definition of “public charge” which threatens immigrant families. With the expanded definition of “public charge,” the administration intends to include the use of Medicaid, Supplemental Nutrition Assistance Program (SNAP), and other essential programs that are critical for immigrant families. The proposed rule’s vast expansion of public charge could have a detrimental effect on immigrant communities, forcing immigrants to choose between their own immigration status and their family’s well-being. The impact of this policy change will be devastating if the proposed rule is implemented. The proposal would make—and has already made—immigrant families afraid to seek programs that support basic needs, including food, health care, and other essentials.
