第一條 本辦法是關於樂暢空間工作室之租賃使用事宜(以下簡稱本空間),並於合約簽名即代表願意遵守相關規定。
第二條 租借本空間場地者,請詳閱租借管理辦法:
空間出租開放時間為週一至週日 09:00-21:00,不分時段使用計費皆一致;
承租最低時數為一小時,最遲需於21:00完成場復離場。
第三條 租用程序﹑租金費用及付款方法:
3.1. 租金將依照本空間「場地租借價目表」計費,租金內含空調﹑一般照明及基本清潔所須費用,不包含因租借(人)清潔及活動前後佈置或清理會場所遺留大宗廢棄物之清除費用。如經本空間通知因租借(人)清理後,仍未能清除遺留大宗廢棄物,本空間將代為清理並加收清理費用 3,000 元整,因租借(人)所遺留之一切物品均當廢棄物處理。
3.2. 場地採預約制,若需場勘,亦請先提早預約,如有需於72小時內臨時預約之特殊情況,請親至本空間洽場地客服人員確認。
租借(人)單位提出使用需求後,租借(人)應在 3個工作日內繳交場租100%為租金,逾期將取消保留;尚未付款期間,如有其它客戶對標的空間亦有需求,將以租金支付之先後順序決定承租權。
3.3.請於付款確認出租後,租借(人)單位回傳「樂暢親子空間出租表單」,內容包含活動計畫及相關負責人之資料,匯款資訊予本空間客服人員,以利進行工作。
3.4. 租借(人)單位之活動因故取消,改期或調整內容,而有解除合約,變動租賃範圍或期間之必要時,最遲應於原訂活動日期 3個工作日前以電子郵件或書面通知本空間客服人員,但不接受退差價事宜,延期之期限限於三個月內,但以乙次為限,經變動後日期不可取消或延期,若取消或延期已付租金全額沒收。
3.5. 租借(人)單位在租借日前 14個工作日取消,已繳交租金全額無息退還;
租借日 3~7工作日前可延期乙次不得作取消,若取消已付租金需全額沒收;若於租借日 3工作日內不接受取消或異動延期者,已付租金需全額沒收。
尚未付款期間,租借(人)單位需以電子郵件或書面通知到達本空間日期為準。
3.6. 租借(人)單位所租借之場地,如遇不可抗力之因素或不可歸責於雙方當事人之事由,如天災、戰爭,因而導致場地之使用取消或變更,得與本空間重議檔期,如因此解約,相關已繳費用本空間將無息退還。
3.7. 如活動日期遭遇颱風來臨,依行政院人事局公佈之臺北市停班停課標準決定是否照常營業,租借(人)單位可選擇全額無息退款或延期舉行。延期之期限限於三個月內,但以乙次為限,經變動後日期不可取消或延期,若取消或延期已付租金全額沒收。
3.8.活動應於承租時段結束後,15分鐘內準時完成撤場,逾時30分鐘後將加收1小時場地費。
3.9.租用當日前請依規定支付場地租金,方能開始使用。如活動臨時須延長租用時間,經客服人員確認同意後,租借(人)單位於租用結束離場時,支付新產生之續租費用。
3.10.場地之租金費用得以現金或匯款方式作事先繳納。

第四條 場地使用規定:
4.1. 配合衛生福利部疾病管制署發佈動態,如需於室內配戴口罩時,未應規定配戴;體溫超過額溫37.5度以上者;未能配合手部消毒者,本空間有權拒絕提供服務,禁止該對象入內。
4.2 禁止攜帶違禁品﹑易燃物﹑易爆物等危險物品及寵物進入本空間。
4.3. 請自行保管攜入之物品,本空間恕不負責任何保管及賠償責任。
4.4. 各場地活動進行之音量不得妨礙其他場地之進行,如違反規定不聽勸阻,本空間有權立即中止活動之進行,費用不退。
4.5. 若於舉辦活動中,需要在空間及公共區域之牆面固著海報及文宣物品,請向本空間客服人員洽詢並取得許可。嚴禁在未告知客服人員之情況下,自行在建物表面進行任何粘﹑貼﹑釘﹑掛等動作,若因此造成建物毁損,租借單位應負責恢復原狀或照價十倍賠償。
4.6. 使用本空間及相關設備器材,應善盡維護保管責任,並遵守本租用管理辦法,若有任何違反或損壞,應負責賠償或修復。
4.7. 租借(人)單位及其承包或施工廠商需自行視需求投保相關保險,任何施工或活動進行中造成財物損失和人員傷亡或不當影響其他人等後果,概由租借單位負損害賠償責任。
4.8. 租借(人)單位在租借場地時間內(含進出場)若發生債務,個人恩怨或私人糾紛等爭議致他人至本空間進行抗議或鬧事影響活動進行,而租借(人)單位無法立即有效處理者,本空間有權終止活動進行,所繳費用概不退還,本空間若因而涉訴訟或受其他損害,租借(人)單位應負一切賠償責任。
4.9. 本空間所有區域及公共區域範圍內全面禁煙﹑嚼食檳榔﹑口香糖及舉行違反善良風俗之活動;租借(人)單位於活動進行中應負責維持會場秩序及保障與會人員安全,依照本空間之規範使用設施,如違反規定不聽勸阻,本空間有權立即中止活動之進行,費用不退。
4.10. 因租借(人)單位(包含使用人及承包商)、與會人員故意或過失,而造成租賃標的之損壞,租借(人)單位及行為人應負連帶責任。
4.11. 租借(人)單位所為會議或課程等活動之內容,不得有詐欺﹑違反公平交易法或其他相關違反法規之情事,否則租借(人)單位應自負其法律責任,與本空間無涉。
4.12. 租借(人)單位不得從事臺北市政府教育局定義之補習班業務內容:
固定場址;固定課表;對外招生廣告;人數達五人以上;收取費用。
4.13. 為考量本空間人員及設備之安全性,備有監控系統,畫面僅為本空間監控人員進出之用途,絕不外流。
4.14. 使用期間如有孳生事端﹑訟爭,租借(人)單位應維護本空間避免受引起的一切對抗行為﹑控告﹑索賠,否則概由租借(人)單位賠償本空間所發生之一切損失,包括但不限於支出之賠償﹑訴訟或律師費用等。
第五條 合約終止:
租借(人)單位如有下列情事之一者,本空間得不經催告立即終止合約停止使用,租借(人)單位不得請求退還各項已繳付之租金及費用:
5.1.未按期限給付『場地租借價目表』或其他約定之服務費用者。
5.2. 租借(人)單位未經本空間同意,將租賃範作轉租﹑分租或轉借與第三人。
5.3. 租借(人)單位未經本空間同意,擅將本空間列為活動之主﹑協辦或贊助單位者。
5.4. 本中心掌握具體證據﹑顯示租借(人)單位計劃舉辦活動違反政府法令規定者或有其他危害公共、人身安全及危害本空間安寧及安全之虞者。
5.5. 活動內容及使用人(單位)與經租借(人)單位簽認報價單所載明顯不符。
5.6. 除以上情事外,租借(人)單位違背本辦法任一條款經制止或通知仍不立即改善者。
第六條 合意管轄:
6.1. 因本空間租賃所生之爭議而涉訟時,以臺灣臺北地方法院為第一審管轄法院。
6.2. 關於本辦法,本空間保有隨時修改之權利。
6.3. 本空間租借管理法自 2021 年 1月 1日起實施。
第七條 本契約未約定事項,悉依中華民國相關法律規定。

Article 1. This agreement is about the rental and use of “Le Second Floor Kids Space Studio” (hereinafter referred to as this space).
Article 2. Those who rent this space, (hereinafter referred to as the customer) shall read the following rental regulations:
Terms Of Use: By signing this rental agreement, the customer agree to the following:
- Space rental opening hours: From Monday to Sunday 09:00-21:00.
- The hourly rate is the same regardless of time.
- The minimum rental period is one hour.
- The lease shall start and end as set forth in this Agreement and no later than 21:00.
Article 3 Rental procedures, rental fees, and payment methods:3.1. The rent will be charged according to the "Venue Rental Price List" of this space.
The rent includes:- air-conditioning
- general lighting
- basic cleaning costs
The rent does not include:- Bulk waste cleaning arrangement of the venue after the event, which shall be done by the customer.
- Removal cost: If the bulk waste is not removed after the customer has been notified by this space, the space will clean up for the customer and an additional cleaning fee of NTD 3,000 will be charged to the customer.
*All items left by the customer shall be treated as waste.3.2. The studio adopts an appointment system. If you need a site survey, please make an appointment in advance. If there is a special situation that requires a temporary appointment within 72 hours, please go to this space and contact the customer service staff of this space to confirm.- After confirmation of the rental date, the integral payment of the rent should be made within the 3 working days upon the confirmation, or the reservation will be cancelled.
- During the period of payment, if there are other customers who have demand for the target space, the right to lease will be determined based on the order of rent payment.
3.3. After confirmation of the payment and rental, the customer should fill out and submit the "Le Second Floor Kids Studio Space Rental Form", which contains the activity plan and the information of the relevant person in charge, to the customer service staff of this space for a full understanding of the purpose of rental.3.4. If the activity of the rental unit is cancelled, rescheduled or adjusted for any reason, and it is necessary to cancel this agreement, change the scope or period of the lease, the customer service staff of this space should be notified of the matter by email or in writing at least 3 working days before the original activity date. However, this space will not refund the difference.- The extended period shall be within three months of the original activity date. Such extension shall only be made for one time.
- After the date is changed, the date shall not be cancelled or postponed anymore. If it is cancelled or postponed, the paid rent will be forfeited in full.
3.5. Cancelation policy:If the customer cancels the event - More than 14 working days before the original date, the paid rent will be refunded in full without interest.
- No refund will be made if cancellation is made less than 14 working days prior to the rental.
- The rent date can be extended once 3-7 working days before the rental day and no cancellation is allowed. If the rental is cancelled, the rent will be forfeited in full; if the cancellation or extension is not confirmed within 3 working days before the rental day, the paid rent will be forfeited in full as well.
During the period of unpaid payment, the renting unit shall notify this space of the arrival date by email or written notice.3.6. In the event of force majeure or causes that are not attributable to both parties, such as natural disasters or war, which result in the cancellation or change of the use of the venue, the customer and this space may renegotiate the schedule; if the agreement is terminated, the relevant paid fees will be refunded without interest.3.7. In the event of a typhoon on the event date, the suspension of work and classes announced by the Directorate-General of Personnel Administration of the Executive Yuan will determine whether this space will operate as usual. The customer can choose to have a full interest-free refund or postpone it.- The extended period shall be within three months of the original event date, but such extension can be made for only one time. The date cannot be cancelled or postponed after the date is changed. If it is cancelled or postponed, the paid rent will be forfeited in full.3.8.The space should be cleaned and vacated within 15 minutes of the end of the rental period.If after the 30 minute , each hour will be billed at the normal hourly rate.3.9. Please pay the rent of the venue in accordance with the regulations before the rental day. If the rental period needs to be extended temporarily for the event and the customer service staff confirms and agrees to such extension, the rental unit will pay the newly incurred renewal fee before vacating the venue.3.10. In cooperation with Taiwan Centers for Disease Control, Le Second Floor reserves the right to refuse service and access to those who:- Have a body temperature exceeding 37.5 degrees Celsius
- Fail to cooperate with hand disinfection
- Refuse to wear mask while indoor (including the balcony)
4.2. It is forbidden to bring contraband, flammable, explosive and other dangerous items and pets into this space.
4.3. Please keep the items you bring in by yourself, this space is not responsible for any incurred losses or stolen items.
4.4. The volume of activities in each venue shall not hinder the progress in the other venues. If you violate the regulations and do not listen to the dissuasion, this space has the right to immediately suspend the activities without refund.
4.5. If you need to display posters and promotion items on the walls of this space and public areas during the event, please contact the customer service staff of this space and obtain the permission. It is strictly forbidden to perform any sticking, pasting, nailing, hanging, etc. on the surface of the building without informing the customer service staff. If the building is damaged due to this, the customer shall be responsible for restoring the building to its original condition or paying ten times the price.
4.6. When using this space and related equipment, you should perform your maintenance and supervision responsibilities, and abide by this rental management agreement. If there is any violation or damage, you should be responsible for compensation or repair.
4.7. The customer and its contractor or construction manufacturer need to insure relevant insurance according to their needs. If there is any construction or activity that causes property loss, personal injury or death, or improper impact to other people, the customer shall be liable for the damages.
4.8. If anyone comes to this space to protest or cause disturbances to affect the activities during the rental period (including entering and exiting) due to the customer’s debts, personal grievances or private disputes, and the customer fails to effectively handle the matter right away, the space has the right to terminate the activity, and the fees paid will not be refunded. If the space is consequently involved in litigation or other damages, the customer shall be liable for all the compensation.
4.9. Smoking, chewing betel nuts, chewing gum, and holding activities that violate good customs are strictly prohibited in all the areas and public areas of this space. The rental unit shall be responsible for maintaining the order of the venue, ensuring the safety of the participants during the activities, and using the facilities according to the regulations of this space. If you violate the regulations and do not listen to dissuasion, this space has the right to immediately suspend the activity without refund.
4.10. If the customer (including the user and contractor) or any of the participants deliberately or negligently causes damage to the lease object, the customer and the one who causes the damage shall be jointly liable.
4.11. The place may be used for legal business activities only.The studio shall not bear any responsibility in case of violation of any law by the customer and its subordinate or contractors.
4.12. The customer is not allowed to engage in the content of the cram school business defined by the Taipei City Government Education Bureau:Fixed site; fixed timetable; advertisement for external enrollment; number of people up to five or more; fee charged.
4.13. For the safety of the personnel and equipment in this space, a monitoring system is used. The records of the monitoring system only cover people’s entering and exiting the space, and will never be disclosed to others.
4.14. In the event of any dispute and litigation caused during the period of use, the customer shall protect the space from all confrontations, accusations and claims; otherwise, the customer shall compensate for all the losses incurred in this space, including but not limited to the compensation, litigation or attorney fees, etc.Article 5 Termination of this agreement:The space may immediately terminate the agreement and immediately stop any on-going activities without refund of the paid rent and expenses under the following circumstances:- The customer fails to pay the fees according to the "Venue Rental Price List" or the other agreed service fees within the time limit.
- The customer Sublet or sub-lend the space to a third party without the consent of this space.
- The customer lists this space as the host, co-organizer or sponsor of the event without the permission of this space.
- This space has specific evidence showing that the customer plans to organize activities in violation of government laws and regulations, or may endanger public and personal safety, and endanger the peace and safety of the space.
- The content of the activity and the customer are obviously inconsistent with the quotation form signed by the customer.
- The customer refuses or fails to improve immediately after being notified of a violation of any of the regulations in this agreement.
Article 6 Consensual jurisdiction:6.1. In the event of litigation resulting from the dispute due to this space lease, the Taipei District Court of Taiwan shall be the court of first instance jurisdiction.
6.2. This space reserves the right to modify the regulations of this agreement at any time.6.3. These space lease management regulations will be implemented on January 1, 2021.
Article 7. Matters not agreed in this agreement are subject to the relevant laws and regulations of the Republic of China.
Article 8. This Agreement is made in Chinese and English. In the event of a dispute as to the terms of this Agreement, the Chinese version shall prevail.
