Non-Discretionary Waivers

Section 22-8B-5 NMSA 1978 of the Charter Schools Act allows certain non-discretionary waivers to be granted by operation of law. Charter school programs must satisfy all other requirements of statute and rule, as applicable. This form provides PED notification of those non-discretionary waivers a charter school intends to claim and allows the department to document those waivers. These non-discretionary waivers continue throughout the term of the charter school’s contract. For purposes of notification and documentation, please inform the Charter Schools Division (CSD) if your school discontinues the waiver during the term of the charter contract. According to NMSA 22-8B-5A, locally imposed school district requirements require a waiver by the local school board.
