INCORPORATION OF SERVICES & PRICING
Agreement: This Agreement incorporates by reference the specific event details, service types, and total fees selected by the Client.
Final Balance: The remaining payment is due immediately upon completion of on-site services.
Late Payment: Per CA SB 988, payments not received by the due date are subject to statutory penalties, including double damages if unpaid after 30 days.
CANCELLATION & REFUNDS
14+ Days' Notice: 100% refund of all payments received (including retainer).
7–13 Days' Notice: DVPIX retains the 25% retainer; all remaining payments are fully refunded.
Under 7 Days' Notice: DVPIX retains the 25% retainer plus 50% of the remaining balance, as custom digital assets and staffing schedules are locked.
Rescheduling: Subject to schedule availability. If DVPIX is unavailable for the requested new date, standard cancellation terms apply.
Provider Unavailability: If DVPIX is unable to perform due to unforeseen circumstances, reasonable efforts will be made to secure a qualified substitute. If no substitute is secured, a 100% refund will be issued.
LIVE PRODUCTION & DELIVERY
Real-Time Access & Curation: A DVPIX assistant proactively deletes blurry or inappropriate photos from the live gallery, which constitutes final delivery. The Client may request the removal of specific images during or after the event. This curation is the only editing provided; no Photoshop or post-processing is included.
Live Overlays: If requested, custom digital frames will be applied live. Client must provide or approve design assets 48 hours prior to the event start time.
Archiving: The live gallery link will remain active for a minimum of 6 months following the event.
TECHNICAL REQUIREMENTS & EXPENSES
Setup Requirements: Minimum 12' × 12' level floor space (for Station setups) and access to one dedicated standard 15-amp outlet within 20 feet.
San Francisco: No travel or parking fees apply for locations within SF city limits.
Outside SF: The Client and DVPIX will agree upon a flat fee covering all travel-related expenses.
Cooperation: The photographer is not responsible for missed shots resulting from the Client’s failure to provide reasonable assistance or cooperation.
LEGAL & PRIVACY
Authenticity Guarantee: Photographer provides "Live" photography representing a factual record. No generative AI is used to alter the physical reality or subjects of the images.
Event Safety & Professional Conduct: To maintain a safe operating environment, DVPIX reserves the right to cease services without refund if personnel encounter hazardous conditions, abusive behavior, or actions that threaten staff safety or equipment integrity.
Liability: Total liability for technical failure or data loss is limited to a refund of fees paid by the Client.
Usage & AI Training: Photographer retains all copyrights. Client is granted a non-exclusive license for personal use. While digital overlays may be AI-assisted, the use of images of people or event scenes for training AI models is strictly prohibited.
Connectivity Disclaimer: Real-time delivery is dependent on cellular or Wi-Fi signal. DVPIX is not liable for delivery delays or failures caused by inadequate venue connectivity or cellular dead zones. In such instances, the gallery will be updated once a stable connection is established.
