General Liability Waiver Form
Release and Indemnity Agreement: 

I understand that participating in the recreational program selected involves risk of injury. These risks include inclement weather, accidents while traveling, equipment problems or failures, contacts with actions of other participants, slips/trips/falls, and musculoskeletal injuries, among others. I choose for myself or for my child to participate in the selected programs despite the risks. When signing the registration form, I acknowledge all risks of injury, illness, and death and affirm that I have assumed all responsibility for injury, illness or death in any way connected with participation in the program. I also agree for myself and for any child participant to follow all rules and procedures for the program and to follow reasonable instructions of the teachers and supervisors of the program. In return for the opportunity to participate in this program, I agree for myself and for my heirs, assigns, executors, and administrators to release, waive and discharge any legal rights I may have to seek payment or relief of any kind from Happy Birdie Badminton, its employees or its agents for injury, illness or death resulting from this program. If I am registering a child for a program, I agree that I am a parent, legal guardian, or am otherwise responsible for the child whose application I am submitting and that I release, waive, and discharge any legal rights that I may request on behalf of the child's participation in the program. I also agree not to sue Happy Birdie Badminton, its employees or its agents and agree to indemnify Happy Birdie Badminton for all claims, damages, losses, or expenses, including attorney’s fees, if a suit is filed concerning an injury, illness or death to me or my child resulting from participation in the program.

Liability Waiver: 
In consideration of entry into any and all activities or programs at the facilities of Happy Birdie Badminton (“programs(s)”), I state and affirm that participation in the programs(s) is not an essential service provided by the Happy Birdie Badminton; that certain risks are inherent and that these risks, anticipated or unanticipated, may result in injury or damage to persons and/or property. I hereby assume all risks in connection with the program(s); agree to hold the city harmless and waive any right to make claims or bring lawsuits for any injuries or damages that are a result of willful, wanton, or intentional misconduct by the city or anyone acting on behalf of the city.

Covid Waiver:
By entering this facility/ field/ programs, you are aware that you agree to fully accept all known and unknown risks, including the potential risk of exposure to respiratory illnesses such as the coronavirus (COVID-19). The coronavirus is primarily transmitted via exhaled respiratory droplets, most often through coughing and sneezing. These droplets can travel up to six feet and are more commonly transmitted between persons rather than from equipment to persons. Although we regularly sanitize our equipment and presently are using enhanced cleaning methods and enforcing social distancing in our facility, you understand that you may be exposed to the coronavirus or its symptoms through no fault of our own. Known coronavirus symptoms include fever, coughing, shortness of breath, pneumonia, kidney failure, and may include other symptoms, stroke or even death (collectively "Symptoms"). You understand and agree that you will hold us harmless and you will not hold us liable for any real or perceived Symptoms of COVID-19 or any other disease, illness, or condition, nor for exacerbating any existing symptoms, and you fully agree to accept all risks of entering the facility, using the equipment, working with personal trainers, attending classes, and/or interacting or being exposed to other members.

Photography Waiver: 
Pictures may be taken of my child or me while participating in Happy Birdie Badminton activities and may be used for program publicity. 

Photo Policy:  
Photographs and video are occasionally taken of participants while they are in programs, special events, city facilities or enjoying parks. I understand, and I am aware these videos and photos of either me, my guests, or my dependent may be published by Happy Birdie Badminton.
