This Photography Services Agreement (“Agreement”) is entered into between Photography by Najah, LLC, owned and operated by Najah Gilreath (“Photographer”), and the undersigned client (“Client”). By booking services with Photography by Najah, LLC, the Client agrees to the following terms and conditions.
1. SERVICES
Photography by Najah, LLC agrees to provide professional photography services as requested by the Client. Services may include, but are not limited to:
Specific session details including date, location, session duration, and package selected will be confirmed at the time of booking.
2. RETAINER AND PAYMENT
A non-refundable retainer is required to secure the Client’s session date and time.
The retainer will be applied toward the total session cost.
The remaining balance must be paid before or on the day of the session.
Failure to submit payment by the session date may result in deleted photos.
Accepted payment methods may include electronic payment, online invoice payment, or other methods approved by Photography by Najah, LLC.
3. RESCHEDULING AND CANCELLATIONS
Client Rescheduling
Clients may reschedule once without penalty if notice is provided at least 72 hours before the scheduled session. Client will forfeit their refund when rescheduling.
Photographer Rescheduling
If the Photographer must reschedule due to illness, emergency, or unforeseen circumstances, a new mutually agreeable date will be arranged.
4. LATE ARRIVAL
Clients are expected to arrive on time.
5. IMAGE DELIVERY
Edited images will be delivered via an online gallery.
Standard turnaround time is typically 7–21 business days, depending on session type.
Expedited editing may be available for an additional fee.
The Photographer reserves the right to select the best images for editing and delivery.
6. IMAGE EDITING
All delivered images are professionally edited by Photography by Najah, LLC.
Editing may include:
Color correction
Exposure adjustments
Skin tone enhancement
Basic retouching
Additional extensive retouching may incur an additional fee.
7. COPYRIGHT AND USAGE RIGHTS
Photography by Najah LLC retains full copyright ownership of all images.
Clients receive a personal usage license, allowing them to:
Share images on social media
Print images for personal use
Use images for personal marketing (if branding session)
Clients may not:
Commercial use requires written approval.
8. MODEL RELEASE
The Client grants Photography by Najah, LLC permission to use photographs taken during the session for:
Portfolio display
Website use
Social media promotion
Marketing materials
If the Client prefers their images not be used publicly, they must notify the Photographer in writing before scheduling the session.
9. LIABILITY
Photography by Najah, LLC will take all reasonable steps to provide high-quality services. However, the Photographer shall not be held liable for circumstances beyond reasonable control, including but not limited to:
In the unlikely event of total image loss, liability shall be limited to the amount paid by the Client.
10. CLIENT RESPONSIBILITIES
The Client agrees to:
Arrive prepared and on time
Secure any necessary location permissions
Ensure cooperation of all participants during the session
The Photographer is not responsible for missed images due to lack of cooperation from subjects.
11. SAFETY
Photography by Najah LLC, reserves the right to terminate a session if the Photographer feels unsafe or encounters inappropriate behavior.
No refunds will be issued in such cases.
12. ENTIRE AGREEMENT
This Agreement represents the entire understanding between the Photographer and the Client and supersedes any prior communications.
Any changes must be made in writing and signed by both parties.
