This Waiver and Release of Liability (the "Waiver") is executed by the undersigned participant ("Participant") in favor of Nothers The Award Store ("Nothers"), its directors, officers, employees, volunteers, and agents (collectively, "Releasees").

1. Participation Acknowledgement Participant acknowledges and agrees that they are voluntarily participating in the Ontario Summer Games 2024 Story Submission Contest ("Contest") hosted by Nothers. The Contest involves submitting a 1-minute video story via Instagram DM to @notherstheawardstore, and providing this signed Waiver.

2. Eligibility Requirements Participant affirms that they are a registered participant in the Ontario Summer Games 2024 held in London, Ontario.

3. Video Submission Participant grants Nothers the right to use, reproduce, distribute, and display the submitted video story for promotional, marketing, and any other purposes related to the Contest and future events without any further consent from or compensation to the Participant.

4. Release and Waiver Participant, on behalf of themselves and their heirs, assigns, and next of kin, releases and discharges Nothers and the Releasees from any and all liability, claims, demands, or causes of action that may arise from or are related to participation in the Contest, including but not limited to any claims arising out of the use of the video submission. The submission may be used for marketing purposes for future contests and may be published on nothers.com or on Nothers The Award Store social media channels.

5. Assumption of Risk Participant acknowledges that they assume full responsibility for any risk of bodily injury, death, or property damage arising out of or related to the Contest, whether caused by the negligence of the Releasees or otherwise.

6. Indemnification Participant agrees to indemnify and hold harmless Nothers and the Releasees from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, brought as a result of participation in the Contest.

7. Governing Law This Waiver shall be governed by and construed in accordance with the laws of the Province of Ontario.

8. Severability If any provision of this Waiver is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of this Waiver shall otherwise remain in full force and effect.

9. Acknowledgement of Understanding Participant has read this Waiver, fully understands its terms, and understands that they are giving up substantial rights, including the right to sue. Participant acknowledges that they are signing this Waiver freely and voluntarily, and intend by their signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
