COVID Waiver of Liability

By signing below, I expressly agree and understand that I am entering the North Coast Athletic Associations North Coast Softball (NCS) league at my own risk. I understand the novel coronavirus COVID-19, has been declared a worldwide pandemic by the World Health Organization (WHO). In accordance with the guidelines issued by the WHO, the United States Centers for Disease Control and Prevention (CDC), and the Ohio Department of Health (ODH), for slowing the transmission of COVID-19, I hereby agree, represent, and warrant that I shall not enter NCS games or activities within 14 days after (i) returning from highly implanted areas subject to CDC Level 3 Travel Health Notice, (ii) exposure to any person returning from areas subject to a CDC Level 3 Travel Health Notice, or (iii) exposure to any person who has a suspected or confirmed case of COVID-19. I am aware of the CDC Travel Health Notices list (https://www.cdc.gov/coronavirus2019-novel/travelers/index.html). I hear by agree, represent, and warrant to not enter NCS if (i) experience symptoms of COVID-10, including, without limitations, fever, cough, or shortness of breath, or (ii) have a suspected or diagnosed/confirmed case of COVID-19.

North Coast Softball has taken reasonable steps to implement recommended guidance and protocols issued by Public Health Agencies for slowing the transmission of COVID-19, including, without limitation, the restrictions set forth above. I understand that inherent dangers for exposure to COVID-19 and other injuries while engaged in activities with NCS, which could result in quarantine requirements, serious illness, disability, and/or death and I hear by assume full responsibility for, and risk of, illness, bodily injury, and death. Having read and understood the above, I recognize the importance of reviewing and following the guidance issued by the WHO, CDC, and ODH, as well as the Boards policies and procedures related the same. By signing this agreement, I agree to be responsible for personal safety and hygiene while engaged in activities with NCS and abide by Board rules and procedures related to social distancing and the use of personal protective equipment (PPE), including, but not limited to face coverings and shields.

I further agree to hold North Coast Athletic Association, its board members, and agents, including any and all policies of insurance, harmless for any and all claims, suites, obligations or other liabilities which arise or may arise out of ny engagement in the aforementioned activities with North Coast Softball. Further, I agree to indemnify and of the aforementioned persons to the extent of any damage claims, including attorney fees, which arise or may arise out of my activities with NCS.

Player Waiver of Liability
*** Please read fully as you will acknowledge that you have read and understand the player waiver of liability below.

In consideration for the privilege to participate in the North Coast Athletic Association, Inc. (hereafter “NCS”)and its associated events. I, myself, my heirs, executors, administrators, and assigns do hereby release, waive and/or forever discharge any and all rights, claims, and causes of action form damage that may be suffered by me as of my precipitation for and/or participate in NCS contests and related activities.

I recognize and voluntarily accept all risks and hazards associated with my participation in softball, no matter how remote or unlikely, including the possibility of serious bodily injury, catastrophic spinal injury, total or partial paralysis, disfigurement, permanent impairment, and even death. I realize that the cause of such injuries include but are not limited to, running, falling, tripling, or being pushed as well as by means of striking or being struck by another participant, a spectator, game equipment or a vehicle.

As an adult, I take full responsibility for my participation in the NCS and for the level at which I choose to be involved. I understand and accept that I am solely responsible for limiting my level of participation, if necessary, with respect to any physical or mental impairment I may have. I affirm that I have the required skills, training, experience and abilities, and am physically fit to the extent necessary for my lever of participation. I also understand that I can choose to remove myself from participating in the NCS or its events at any time.

I do not expect the NCS, its agents, volunteers or officers to coach, manage, instruct, or train me for the activities. I also recognize that it is my responsibility to learn, understand, and obey the rules of softball and NCS.

I am fully aware and agree that I cannot, in whole or in part, rescind, revoke, or otherwise withdraw the foregoing Waiver and Release of All Claims. I also realize that it will not expire and that no activity by me shall cause it to be terminated, extinguished, or canceled in any way.

I thoroughly understand that the foregoing Waiver and Release of All Claims is intended to be as broad and inclusive as is permitted by the laws of the State of Ohio and that if any segment or section therefore is ruled to be invalid, to withstanding the portion, I expressly agree that the balance shall continue in full legal force and effect.

I have carefully read the hold-harmless waiver and Release of All Claims and full understand its contents, meanings and effect as a complete waiver and release of all claims, liability, and indemnity for the NCS, its agents, volunteers, and officers.

Safe Play Guidelines
*** Please read fully as you will acknowledge that you have read and understand the safe play guidelines below.

1. All players, umpires, and spectators are required to perform a self- assessment before coming to the fields. If they do not feel well, are running a fever, or exhibit any signs of COVID19, do not come to the game.

2. If someone has a positive test COVID test (fan, umpire, spectator) the league needs to be notified immediately. Please reach out to commissioner@northcoastsoftball.org or a message to the NCS facebook page. We do not need to know the name of the player, just the team. We will shut down for one week. These games will be put onto the back of the season.

3. Teams will be provided with two balls, one brand new and one in good condition. Those are the balls the team is to use that week. Please use your discretion weekly if you will need another new ball.

4. The only players allowed to touch that ball are those on the team. For example, if Team A hits Team B’s ball foul and over the fence, a member from Team B must be the one to retrieve.

5. No gum, seeds, or spitting.

6. All registration and money will be done online.

7. Mask use at personal discretion.

8. Dugouts may be used however bleachers are reserved for players that wish to socially distance. Spectators may sit anywhere else in the park excluding the dugout and bleachers.

9. NO ALCOHOL for both players and spectators. This is a new guideline for use of the city of Cleveland fields.

10. Double headers only, teams play the same team for both games.

11. Sanitize bats before each use if sharing.
