ATTENTION: THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS. PLEASE READ THIS ENTIRE DOCUMENT CAREFULLY. This waiver will release and indemnify Hockey Helps the Homeless, RBC Centre, all sponsors including all of their employees, officers and agents (among others), against any and all losses, claims, actions, damages, costs, liabilities, expenses and demands whatsoever for illness, death, personal injury, damage or loss to property and any and all other loss or injury, including, without limitation, economic loss, incidental or consequential damages, suffered arising in any manner from or out of participation in or spectating at the event.

SIGNING THIS RELEASE AND INDEMNITY MEANS YOU HAVE READ AND VOLUNTARILY AGREE TO BE BOUND BY ITS TERMS
I, the undersigned, in consideration of being permitted to participate in or spectate at the 2023 Hockey Helps the Homeless Tournament and in connection therewith being permitted to enter upon the lands and premises of and surrounding RBC Centre, November 10th, 2023.

(a) do hereby unconditionally remise, release and forever discharge all sponsors, Hockey Helps the Homeless, and RBC Centre, (collectively the “Entities”) and their officers, employees, servants, agents, affiliates and successors (collectively the “Representatives”) and each of them from and against any and all losses, claims, actions, damages, costs, liabilities, expenses and demands whatsoever (collectively the “Claims”) for the exposure to or contracting of any illness, including but not limited to COVID-19, death, personal injury, damage or loss to property and any and all other loss or injury, including, without limitation, economic loss incidental or consequential damages (collectively “Damages”), that I may suffer or that my family, heirs, assigns, personal representatives, estate and/or any other person(s) may suffer due to any cause whatsoever and arising in any manner from or out of my participation in or spectating at this event or entering into the RBC Centre or upon its surrounding lands and premises, whether occasioned, wholly or in part, by any act or omission, whether negligent or otherwise, including without limitation, negligence, breach of contract, or breach of any statutory or other duty of care on the part of any one or more of the Entities or Representatives; and

(b) shall indemnify and save harmless the Entities and the Representatives and each of them from and against any and all Claims for any and all Damages that I may suffer or that my family, heirs, assigns, personal representatives, estate and/or any other person(s) may suffer due to any cause whatsoever and arising in any manner from or out of my participation in this event or entering into the RBC Centre or upon its surrounding lands and premises, whether occasioned, wholly or in part, by any act or omission whether negligent or otherwise, including without limitation, negligence, breach of contract, or breach of any statutory or other duty of care on the part of any one or more of the Entities or Representatives.

Notwithstanding the generality of the foregoing, I agree that I will not commence litigation or make any claim or otherwise recover damages or compensation against or from any Entity or Representative arising out of or in any way connected with this event, and I agree that this Release and Indemnity shall be a complete defense to any claim, proceeding or action, of any kind or nature based on any theory of liability against the Entities or Representatives.

I acknowledge that hockey, by its nature, requires close physical and shared contact with other individuals and that in my role as a volunteer, I may have close physical or shared contact with other individuals and that such close physical and shared contact may expose me to illness, including but not limited to COVID-19. I accept personal responsibility for the risk of exposure and the risk that I may contract, as well as the actual contracting of, any illness from my participating in or spectating at this event, notwithstanding any health issues or loss which may occur in connection therewith.

I acknowledge and agree to the use of photographs and video images of myself taken at the event for future promotional purposes by Hockey Helps the Homeless and their sponsors.

I acknowledge and agree that this Release and Indemnity shall be binding on myself and my heirs, executors, administrators, successors and assignees and anyone claiming through me or them and shall inure to the benefit of the Entities and the Representatives and their respective heirs, executors, administrators, successors and assigns.

It is UNDERSTOOD that the party receiving this Release and Indemnity does so on behalf of each and every person and class of persons so released and indemnified and that the said permission is given or shall be deemed to have been given by each such person and class of persons as consideration for my release.

This Release and Indemnity shall be governed by and construed under the laws of the Province of Nova Scotia. Any dispute arising under or in any way connected with this Release and Indemnity shall be determined by the courts of the Province of Nova Scotia.

Note: You are free to seek independent legal advice regarding this waiver.

I have read (or have had read to me) this Release and Indemnity, fully understand its terms and voluntarily agree and accept its terms.
