AFFIRMATION OF UNITED STATES HANG GLIDING AND PARAGLIDING ASSOCIATION RELEASE,  WAIVER AND ASSUMPTION OF RISK AGREEMENT AND ACKNOWLEDGMENT OF APPLICABILITY TO USHPA CHAPTER

Flight Under FAA Regulation "Part 103 is based on the assumption that any individual who elects to fly an ultralight vehicle has assessed the dangers involved and assumes personal  responsibility for his/her safety". FAA AC-103-7  

In consideration of being allowed to use the facilities and participate in the sport of "Ultralight Vehicles" and other activities (collectively the “Activities”) provided by Central California Hang Gliding   Paragliding Club (the "USHPA Chapter"), I hereby reaffirm the United States Hang Gliding And Paragliding Association (“USHPA”) Release, Waiver and Assumption of Risk Agreement (the “USHPA Release”) previously signed by me and acknowledge that it is applicable to my participation in any and all Activities of the USHPA Chapter. Each of the terms, including the definitions, of the USHPA Release are hereby incorporated by reference as though fully set forth in this affirmation. I specifically acknowledge that the following persons, including their owners, officers, directors, managers, agents, spouses, employees, officials (elected or otherwise), members, independent contractors, sub-contractors, lessors and lessees, are also RELEASED PARTIES as that term is used in the USHPA Release:

Central California Hang Gliding Paragliding Club, and each of its members, employees, agents, volunteers, officers, directors, and managers:

This specification of certain RELEASED PARTIES is not meant to be an all-inclusive list or to limit in any way the scope of persons included within the definition of RELEASED PARTIES in the USHPA Release. Rather, it is made to give assurance to those listed here that they are included within the scope of the definition of RELEASED PARTIES in the USHPA Release. Ultralight Vehicles includes powered and unpowered hang gliders and paragliders. Mini-wings and speed-wings are types of paragliders.This affirmation in no way limits, restricts or narrows the terms or scope of the USHPA Release previously signed by me.

I acknowledge that hang gliding and paragliding is an action sport and recreational activity involving travel in three dimensions and that my participation in such activity may result in mishap and injury. I understand I may suffer physical injuries including but not limited to broken limbs paralysis or fatal injury while participating in the sport of hang gliding and paragliding *
In consideration of the use of hang gliders, paragliders, or other related equipment hereafter collectively called the equipment or services of the Central California Hang gliding Paragliding Club "CCHPC" or Ron Jones, Christy Splan, Officers of the club and the use of the facilities located at Tollhouse launch and Landing and Dunlap Launches and Landing (see maps/website and RRRG for coordinates), in connection with my participation in the sport of hang gliding and paragliding, flight instruction, and related activities here after collectively called hang gliding paragliding activities I hereby understand and agree to this Release of liability waiver of legal rights and assumption of risk as follows: *
I hereby RELEASE AND DISCHARGE Ron Jones, Christy Splan, the Central California Hang gliding & Paragliding Club "CCHPC" and their respective officers, directors, agents, instructors, pilots, members, and owners of equipment and the land and premises used for hang gliding and paragliding activities (hereinafter collectively referred to as "released parties") from any and all liability, claims, demands or causes of action that I may hereafter have for injuries or damages arising out of my participation in hang gliding or paragliding activities, including, but not limited to losses or damages CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES *
I understand and acknowledge that hang gliding and paragliding activities have inherent dangers that no amount of care, caution, instruction, or expertise can eliminate and I EXPRESSLY AND VOLUNTARY ASSUME ALL RISK OF DEATH OR PERSONAL INJURY SUSTAINED WHILE PARTICIPATING IN HANG GLIDING OR PARAGLIDING ACTIVITIES WHETHER OR NOT CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES *
I further agree that I WILL NOT SUE OR MAKE A CLAIM against the released parties for damages or other losses sustained as a result of my participation in hang gliding or paragliding activities. I also agree to INDEMNIFY AND HOLD THE RELEASED PARTIES HARMLESS from all claims, judgments and costs, including attorneys fees incurred in connection with any action brought as a result of my participation in hang gliding and or paragliding activities *
I will take full responsibility for, and hold harmless all released parties for any injury that I may suffer or inflict upon others or the property as a result of my engaging in hang gliding and/or paragliding activities *
I agree that I will operate the equipment in a responsible and safe manner so as not to endanger the lives of persons or property of any individual and that course fees do not cover equipment damage *
I have read and understand the above and acknowledge that the same constitutes a release of liability and a waiver of my legal rights and also acknowledgment of the assumption by me of all risks arising out of my engaging in hang gliding and/or paragliding activities *
I further represent that this release of liability, waiver of legal rights and assumption of risk shall continue in force and effect for so long as I engage in hang gliding and/or paragliding activities which are in any way connected to or with the released parties *
I hereby expressly recognize that this release of liability, waiver of legal rights and assumption of risk is a contract pursuant to which I have released any and all claims against the released parties resulting from my participation in hang gliding and/or paragliding activities, including any claims caused by the negligence of the released parties *
10. I will take full responsibility for, and agree to defend and hold harmless all released parties for any injury to property or persons that I or anyone I bring onto the landing area property, may suffer by any other activity besides flying activities on the property known as the "Tollhouse LZ" For example: all all activities (but not limited to), camping, barbecuing, sports, bicycling, hiking, playing, tree fall, wood chopping, lawn mowing, climbing, horse-play, Etc. *
