Event Overview
Culturefest 2018 will be held on Saturday, June 23 in ChocolateTown Square Park and the streets of Downtown Hershey. This festival features the work of fine artisans, great live music on multiple stages, performances, children's activities, craft beer and wine, and a variety of delicious food. Culturefest is free and open to the public.
Food Vendor Agreement
The Downtown Hershey Association will approve food vendor applications based on the quantity and quality of applications received.

VENDOR SPACES
Vendor spaces may be located on asphalt or grass.

Vendors are requested to bring a tent or canopy for their site if they are not contained in a food truck. All tents must be commercial grade pop-up or free standing frame tents. All tents must be secured by weights or stakes at each corner of the tent. No stakes may be driven into concrete or asphalt and weights or stakes cannot be more than 6 inches away from the legs of the tent.

Vendors must display pricing for all products offered for sale. Failure to display pricing may result in removal from the event or exclusion from future events.


VENDOR FEES
Food vendor space fees are based on the size of the vendor space, and will be determined using the formula length (ft) x width (ft) x $1, with a minimum fee of $100. For example, a food vendor occupying a 10x10 tent will need to submit payment of be $100; a vendor requiring a 10x20 space would need to submit payment of $200. Vendors must submit payment in the form of a check made payable to the Downtown Hershey Association prior to the event. The Downtown Hershey Association is a 501(c)3 nonprofit corporation. Checks can be sent to Downtown Hershey Association, c/o Culturefest, 600 Clearwater Road, Hershey, PA 17033.

We ask that food vendors wishing to sell beverages do not sell alcoholic beverages, soda, or water.

Setup on the day of the event will begin at 9:00 AM. Vendors are asked to have setup complete by 11:30 AM. All vendors must be completely self-contained. The Downtown Hershey Association will not be supplying tents, tables, electricity, ice, water, or trash removal.

Additional Named Insured:
The vendor shall furnish the Downtown Hershey Association and the Township of Derry with one (1) copy of a Certificate of Insurance issued by a reputable insurance carrier. The Downtown Hershey Association and the Township of Derry must be named as an additional insured for all coverage, other than Workman’s Compensation and Employers Liability. This Certificate of Insurance shall reflect the actual amount of insurance in force.

Indemnity Agreement:
The vendor shall indemnify and hold harmless the Downtown Hershey Association and the Township of Derry and their officers, agents and employees from any and all liability, losses or damages, including attorney’s fees and cost of defense, the event organizers may suffer as a result of claims, demands, suits and actions or proceedings of any kind or nature, including worker’s compensation claims, in any way resulting from or arising out of the operations of the Vendor under this contract including operations of any sub-vendors, and the Vendor shall at his or her own expense appear, defend, and pay all charges of attorney’s and all costs and other expenses arising there from or incurred in connection therewith; and if any judgments shall be rendered against the event organizers in any such act, the Vendor shall, at his or her own expense satisfy and discharge same. The Vendor expressly understands and agrees that any performance bond or insurance protection required by the contract, or otherwise provided by the vendor, shall in no way limit the responsibility to indemnify, keep and save harmless and defend the event organizers herein provided.

In the event of any conflict between the language of the insurance policy(s) and the above recited indemnity agreement, the indemnity agreement shall govern.

Insurance:
Policy Cancellation/Change Notice:
The Vendor shall furnish a certified copy of the insurance policy (s) to the Event organizers upon request. The policy(s) shall provide, in the event the insurance should be changed or cancelled, such change or cancellation shall not be effective until sixty (60) days after the Event organizers has received notice from the insurance company (s).

Types and Amounts of Insurance:
Commercial General Liability for Bodily Injury and Property Damage (occurrence form) including General Coverage, Broad Form Property Damage, Personal Injury Liability. Additionally the Association will be named as an additional insured. Amount of Coverage: $1,000,000

Comprehensive Auto Liability for bodily injury and property damage arising out of owned, non-owned and hired vehicles. A combined single limit of $1,000,000 per occurrence is required.

Workers’ Compensation and Worker’s Occupational Disease (Workers comp insurance) limits of coverage shall be as required by law in the Commonwealth of Pennsylvania. This shall include coverage for all persons whom the Vendor may employ directly or through sub-vendors in carrying out the work described in this contract. The vendor shall provide evidence that the vendor has Workers’ Compensation and Worker’s Occupational Disease insurance protection for his/her employees.

Employer’s Liability:
Bodily Injury by accident: $100,000 per accident
Bodily Injury by disease: $100,000 per employee, $500,000 aggregate.
