Participation Agreement, Liability Waiver, and Hold Harmless Release

By submitting this form, I agree to the following terms. If the Participant is under 18, a Parent/Guardian must submit on their behalf.

1. Definitions
- “Pitch Labs”: Pitch Labs, Inc., its officers, directors, volunteers, mentors, representatives, sponsors, and partners.
- “Participant”: The student submitting an entry.
- “Parent/Guardian”: The legally responsible adult signing for a Participant under 18.
- "Competition” or “Pitch Fest”: The Pitch Labs innovation competition and all related events.

2. Voluntary Participation
The Participant voluntarily enters the Pitch Fest competition, which may include pitch submissions, presentations, and interactions with judges or mentors.

3. Assumption of Risk & Waiver of Negligence Claims
The Participant assumes all risks associated with participation, including risks arising from ordinary negligence by Pitch Labs.

The Participant waives the right to bring claims for injuries, losses, or damages arising from participation.

4. No Guarantee of Funding or Outcomes
Participant understands Pitch Labs does not guarantee:
- Funding or investment
- Awards or prizes
- Business outcomes or opportunities
- Accuracy of judge feedback

All judges’ decisions are final.

5. No Employment, Partnership, or Fiduciary Relationship

Participation does not create employment, agency, partnership, a joint venture, fiduciary duty, or any other obligation or relationship, not expressly stated here in this agreement, from Pitch Labs to any party.

Pitch Labs is not responsible for business decisions made by Participants.

6. Intellectual Property & Non-Confidentiality
- The Participant(s) retain(s) ownership of their ideas.
- Pitch Labs cannot guarantee confidentiality of submissions or presentations.
- The Participant is solely responsible for protecting their intellectual property (e.g., patents, trademarks).
- Participant grants Pitch Labs permission to display and evaluate submissions for judging, educational, and promotional purposes. Participants should not submit anything they deem 'trade secret' or the exposure of which materials may cause harm to their business.

7. Release of Liability & Indemnification
The Participant releases, indemnifies, and holds harmless Pitch Labs from all claims related to participation, idea exposure, or conduct of others, except for gross negligence or intentional harm.

8. Media Consent
Participant, regardless of submission outcomes, grants Pitch Labs permission to use and publish submission content (including the submitted pitch video and contents), photographs, videos, and recordings for promotional and educational use, without compensation nor a requirement of additionally or separately granted participant consent.

In the event the Participant or their team receives an award, recognition, or finalist placement, the Participant grants Pitch Labs a perpetual, worldwide, royalty-free license to use and publish the Participant’s name, image, likeness (NIL), voice, and submitted pitch content for promotional, advertising, educational, program development, organizational development, awareness, or marketing purposes across all media channels, without further approval or compensation.

9. Severability
If any part of this agreement is deemed unenforceable, all remaining portions stay in effect.

10. Acknowledgment of Understanding
By submitting this form, the Participant (or Parent/Guardian for themselves and the Participant) confirms:
- They have read and understand this Agreement.
- They voluntarily agree to its terms.
- They understand they are waiving certain legal rights, including rights to sue for ordinary negligence.
