The parties hereby agree TGNCDC will screen, on behalf of Owner, prospective tenants to determine suitability for leasing of Owner’s property located at the above address(es).The parties agree that TGNCDC will conduct said screening utilizing the following: Credit Check, Criminal Background Check (including registered sex offender databases), Residential History / Landlord verification, Income and Employment verification. Owner agrees to exclusively use the application and supplemental forms provided by TGNCDC for the purpose of tenant screening and shall adhere to the screening guidelines of TGNCDC. The owner will receive a copy of all completed tenant screening applications. TGNCDC will formulate a written recommendation to Owner reflecting TGNCDC’s determination as to the suitability of a prospective tenant for the rental property and will provide such recommendation to Owner. However, Owner understands and agrees that no specific information about a prospective tenant, including the person’s credit report or portions thereof, will be released or given to Owner. Following receipt of TGNCDC’s written recommendation, Owner shall inform TGNCDC of Owner’s final decision with regard to the prospective tenant. In the event that Owner elects not to lease the property to a prospective tenant who is not recommended, TGNCDC shall inform the prospective tenant of such decision in writing. If the prospective tenant was recommended but Owner decides not to lease the property to tenant, Owner must inform the tenant. This agreement shall commence on the effective date of this Agreement which is shown above and shall continue for a period of one year. Therefore, this Agreement shall be automatically renewed for successive one year terms unless a party submits a written notice to terminate the agreement at least thirty (30) days prior to the expiration date. Additionally, this Agreement may be terminated by either party upon a thirty (30) day written notice to the other party. The parties hereby agree that TGNCDC will charge a $42.00 non-refundable fee for each individual 18 years of age and older who seek to reside in the unit for the purpose of application screening. All fees shall be paid at the same time that an application is submitted to TGNCDC. In the event that payment is not made, the parties agree that the application will not be processed. The parties agree that Owner and TGNCDC and all agents retained on its behalf shall follow all Fair Housing and Equal Housing Opportunity guidelines and laws and other applicable federal, state and local laws. The parties understand that TGNCDC is relying on third party sources for information on which it bases its recommendations. While TGNCDC agrees to make reasonable attempts to verify information provided by third party sources, Owner agrees that TGNCDC cannot make any assurances with regard to the information provided and the resulting recommendation. TGNCDC and its agents assume no liability and Owner agrees to hold TGNCDC harmless with regard to any act or omission by TGNCDC during the screening process and relating to the recommendations made by TGNCDC to Owner. TGNCDC assumes no liability for charges due to Owner, or in the performance of any obligation owed by tenant to Owner, including, but not limited to, payment of rent and performance under the lease. Nothing in this agreement shall be construed as the assumption of liability or responsibility on the part of TGNCDC for such tenant obligations. Owner hereby agrees to indemnify, protect and hold harmless TGNCDC from and against the loss, cost, claims, demands, damage and/or expense arising out of any demand, claim, suit or judgment for damages to property and injury to or death of persons including the officers, agents and employees of either party herein, which may arise out of or relate to Owner’s decision to lease property, Owner’s actions, omissions and conduct as Lessor of the property, and the information and recommendation transmitted to Owner by TGNCDC.
