Fair Use
To be in compliance with copyright law, permission must be obtained from copyright holders to stream films (feature films, documentaries, television programs, etc.) and/or music in your class. Casper College instructors are responsible for acquiring needed use permissions beyond those provided by the Copyright Act and Fair Use. If you have questions or need help with Copyright please feel free to contact Brad Matthies 307-268-2036 or the Digital Learning Department 307-268-3882.

Fair use of a copyrighted work is not an infringement of copyright and you are not required to obtain permission from the copyright holder to use the work. In determining whether the use made of a work in any particular case constitutes fair use, the factors to be considered shall include:

1. The purpose and character of the use, including whether such use is of a commercial nature, or is for non-profit educational use (NOTE: streaming a film in its entirety is NOT covered under Fair Use);
2. the nature of the copyrighted work;
3. the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
4. the effect of the use upon the potential market for or value of the copyrighted work.”

Some helpful resources to assist in determining with a particular use constitutes fair use include: American Library Association's "Fair Use Evaluator" Dr. Kenny Crews' (Columbia Univ.) "Fair Use Checklist"
