READ CAREFULLY BEFORE ACCEPTING. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS.

This release applies to the fullest extent permitted by law.

1. DEFINITIONS

“Releasees” means VeloPigs Cycling Club, Plum Grove Cyclery, and all of their respective officers, directors, managers, ride leaders, members, volunteers, agents, representatives, sponsors, advertisers, event organizers, other participants, and, if applicable, the owners or lessors of premises on which any Activities occur.

“Activities” means all bicycle rides, group rides, races, training sessions, skills clinics, outdoor activities, community service events, programs, and any other events or services organized, led, recommended, promoted, or authorized by the Releasees.

2. ASSUMPTION OF RISK

I understand and acknowledge that cycling involves inherent and significant risks, including but not limited to:

· Motor vehicles

· Road hazards such as potholes, gravel, debris, uneven pavement, and construction

·  Weather conditions

·  Mechanical failures

· Collisions with riders, pedestrians, animals, or objects

· Limited access to medical care in remote areas

· Physical exertion, dehydration, hypothermia, and other health-related risks

I understand these risks cannot be eliminated without jeopardizing the essential nature of the Activities. I voluntarily choose to participate with full knowledge of these dangers and accept full responsibility for my own safety.

3. PARTICIPANT RESPONSIBILITIES

I agree to:

· Ride safely, predictably, and within my personal limits

· Maintain my bicycle and equipment in safe working condition

· Wear a properly fitted helmet at all times

· Follow all traffic laws and ride leader instructions

· Not participate while under the influence of alcohol, drugs, or impairing substances

· Immediately stop participating if I believe conditions are unsafe or if I feel unwell

· I understand that I am solely responsible for my equipment and personal conduct.

4. RELEASE AND WAIVER OF LIABILITY

In consideration of participating in Activities, I hereby:

· Release, discharge, and covenant not to sue the Releasees for any injury, loss, damage, or death arising from my participation in Activities, including those caused by the negligence of the Releasees

· Waive any and all claims, known or unknown, that I or my next of kin may have against the Releasees

· Understand that negligence includes the Releasees’ failure to safeguard or protect me from risks inherent in cycling

5. INDEMNIFICATION

I agree to hold harmless and indemnify the Releasees from any liability, claims, damages, costs, or expenses (including attorney’s fees) arising from:

· My participation in Activities

· My actions or omissions

· Injury or damage I may cause to myself and others

6. MEDICAL CONSENT

I authorize the Releasees, ride leaders, or emergency personnel to secure medical treatment for me if necessary. I agree to be financially responsible for any such treatment.

7. MEDIA RELEASE

I grant permission for the Releasees to use photographs or videos of me participating in Activities for promotional or informational purposes, without compensation.

8. GOVERNING LAW

This Agreement is governed solely by the laws of the Commonwealth of Virginia. 

9. SEVERABILITY AND INTEGRATION

If any portion of this Agreement is found invalid, the remainder shall continue in full force. This Agreement is the entire understanding between the parties and supersedes all prior representations. 

10. ELECTRIC BICYCLE AGREEMENT INCORPORATED BY REFERENCE

If I choose to participate in Activities using an electric bicycle (“E‑Bike”), I understand that the VeloPigs Cycling Club maintains a separate E‑Bike Use Agreement that outlines additional rules, requirements, and safety obligations specific to e‑bike operation.

· My acceptance of this Release and Waiver constitutes acceptance of all terms contained in the E‑Bike Use Agreement. 

11. SUPERSEDING PRIOR AGREEMENTS

This Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement supersedes and replaces all prior versions of any release, waiver, or similar agreement previously executed in connection with the Activities. 

12. ACKNOWLEDGMENT AND ACCEPTANCE

I am 18 years of age or older. I have read and understand this Agreement. I understand that by accepting below, I am giving up substantial legal rights. I accept this Agreement freely and voluntarily, without inducement.
