Language providing flexibility for the Paid Lunch Equity (PLE) requirement for school year (SY) 2019-20 was included in the FY 2019 Consolidated Appropriations Law (Public Law 116-6). It is similar to the flexibility provided for SY 2018-19. However, for SY 2019-20, only a school food authority (SFA) that had a negative balance in its nonprofit school foodservice account as of December 31, 2018 shall be required to establish a price for paid lunches in accordance with 7 CFR 210.14(e). Any SFA with a positive or zero balance in its nonprofit school foodservice account as of December 31, 2018 is exempt from PLE requirements for SY 2019-20.

State agencies are required to demonstrate oversight of this provision and thus need to maintain documentation that includes a record showing each SFA implementing the exemption had a positive or zero balance in the nonprofit school food service account as of December 31, 2018.
